When I am retained, the first thing I do is subpoena all the evidence or request such evidence through a discovery motion in court. Evidence in a criminal case does not just include the police report. Other evidence exists which is typically not given to the defense unless it is specifically requested. Evidence such as calibration logs and accuracy logs of a breath machine (in a DUI case, for example), police dispatch logs, belt recordings, police vehicle dash cameras, jail video, witness statements, lab test results, etc... are examples of additional evidence that could prove crucial to building a defense.
