Overview
Eli Wagschal understands the complexities of New York premises liability claims and fights for his clients with integrity, compassion and tenacity. Eli received his J. D., cum laude, from Pace University School of Law and was honored with the Judge Richard J. Daronco Award as the best student advocate of 2017 in his representation of indigent clients charged with misdemeanor offenses in the Bronx County Criminal Court. Eli aims to ensure that his clients, regardless of their background, are well represented and compensated fairly for their suffering and loss.
Outside of the practice of law, Eli enjoys cooking exotic and unusual dishes for his wife and spends the rest of his time spoiling his beautiful baby girl.
Since graduating law school, Eli has been instrumental in securing millions of dollars for his clients and obtained one of the top personal injury settlements in New York State, as recognized by TopVerdict.com. Recent case resolutions include:
- $3.85 million dollars for two young girls with severe learning disabilities caused by exposure to unhealthy lead levels at the apartment where they lived for two years.
- $1.5 million for the family of a 22-year-old man who committed suicide while incarcerated at Marcy Correctional Facility after corrections officers denied him recreation time and lunch.
- $1 Million for a motorcyclist who was severely injured after being struck by a rental vehicle. Although the vehicle was a rental with a $25 thousand policy, Eli sued the car rental company and creatively formed an argument establishing an exception to the Grave's Amendment which protects car rental companies from liability arising out of a renter's negligence; the rental company ultimately tendered its $1 million policy limit.
- $700 thousand for the family of a 4-year-old girl with severe anemia who was struck by a falling cabinet at school which caused her to die almost instantly.
