    Hired Attorney 2020-2021
We got stuck with this lawyer as a Special Administrator of my brother's estate, and now we are fearful that we will never get him out of our business. He was appointed on 10/22/2020. He did not pay bond until 11/12/2020 delaying any start of the estate being handled by 3 weeks. Then, he did nothing to contact us until 4 weeks later after my sister called him. Another delay. Then, he called me and brushed me off with needing to read the court file. The court file was merely information I gave a different Attorney in July of 2020, some of which had changed. On 1/14/2021 I caled my brother's bank and checked his bank account which had not been touched. So he had not secured the estate funds and opened an estate account after 2 months. We had 2 cars that were costing us money to insure. It took Mr. Colley 4 months to get around to signing paperwork to sell them. Another unreasonable delay. He stuck me paying the estate bills from money that was not part of my brother's probate estate for 7 months. He refused to pay the bills that whole time. Then, when the claim period was up and he should be closing the estate and transferring stuff to the heirs, he said he would do that within a month, but instead started putting all bills in C?O Louis Colley. He said in May 2021 it would take about a month to close the estate. It has been 3.5 months and he is now saying October. This attorney has brushed off our family, he has lied to our family, and he has delayed things for no good reason, all of which costs us money. He really doesn't care at all how much he costs us, cause from everything he says, this estate is all about Louis Colley. One of the heirs lives on SSD and would really like us to be able to move forward, but Louis Colley doesn't care. It is all about him delaying things or doing them at his convenience. By delaying from June or July closing the estate it will cost us additional money that we might not have been paying, if he had not decided he can hold up our stuff as long as he wants. Its his ego trip. And the heirs are all women. So I'm sure we should all be waiting on him.

How do I choose a lawyer?

Consider the following:

  • Comfort Level – Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?
  • Credentials – How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?
  • Cost – How are the lawyer's fees structured — hourly or flat fee? Can the lawyer estimate the cost of your case?
  • City – Is the lawyer's office conveniently located?

Not sure what questions to ask a lawyer?

Here are a few to get you started:

  • How long have you been in practice?
  • How many cases like mine have you handled?
  • How often do you settle cases out of court?
  • What are your fees and costs?
  • What are the next steps?

Want to check lawyer discipline?

It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:

  • Ensure the attorney is currently licensed to practice in your state
  • Gain an understanding of his or her historical disciplinary record, if any.
  • Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
