I needed a good attorney to file bankruptcy for the first time and only time in my life. I was very nervous and I had no idea what I was getting into. I met with attorney Bear and he assured me I could file a chapter 7 with no problems and its simple and easy. I felt excited to finally have a lawyer to help me with this issue.I didn't know it would turn into a even worse situation for me. I was told to get a list of paperwork that he would need and I did everything for him. I was told to give $1250 dollars he said around 350 for a filing fee 900 for attorney fee. I Paid upfront right away. I worked to get all the paper work necessary to file my case and I would email and try to call attorney Bear multiple times without a reply, even after I turned in all my paper work. I had to call him and continue to bother him to ask about any updates and if I had all the necessary paperwork. Weeks later I finally got to meet with Attorney Bear he pulled me into his meeting room and told me I will be filing a chapter 13 instead of a 7 and that he would need an additional 2250 dollars to file it. My stomach turned and I was so lost and confused. I told attorney Bear I need to think about it and I left. I called 3 other attorneys and met with one, who told me I have a strong chapter 7. The next day I went back to Attorney Bear to get my money back. They said I couldn't have the check until I signed paperwork stating that I will pay 900 of my money for time spent on my paper work. I didn't sign it in the beginning or at this time and I wasn't going to. Attorney Bear came into the lobby and continued to try to get me to sign the paperwork I wouldn't and I asked him " Did you contact me once while working on my case? Did you inform me of it being a chapter 13 at all?" his answer was "no'. I cant speak for any of the other lawyers but I got taken advantage of by Attorney Bear. He never gave me my 900 back. I never sighed any paperwork stating I would pay for the fees. I would of never continued with him working on my case if he would of communicated with me that I couldn't file a chapter 7. He is a criminal and a scam artist. DO NOT WORK WITH HIM. I also received paper work on his other clients with personal information on it. very unprofessional. I went with another attorney and filed a chapter 7 within a week and I've been discharged already.

How do I choose a lawyer?

Consider the following:

  • Comfort Level – Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?
  • Credentials – How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?
  • Cost – How are the lawyer's fees structured — hourly or flat fee? Can the lawyer estimate the cost of your case?
  • City – Is the lawyer's office conveniently located?

Not sure what questions to ask a lawyer?

Here are a few to get you started:

  • How long have you been in practice?
  • How many cases like mine have you handled?
  • How often do you settle cases out of court?
  • What are your fees and costs?
  • What are the next steps?

Want to check lawyer discipline?

It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:

  • Ensure the attorney is currently licensed to practice in your state
  • Gain an understanding of his or her historical disciplinary record, if any.
  • Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
