Hired Attorney 2024My trouble with Swomley and Associates began almost imideately when John Swomley showed up at least two hours late to my Monday arraignment. After at least five frantic phone calls he finally showed up and claimed that he forgot (even though I had engaged his services that weekend). When my name was first called I had to go up to the front of the court and awkwardly tell the judge my attorney had not yet arrived. He also provided a quote to the Boston Globe about my case without first reaching out to me. Although the quote was somewhat benign I would have strongly preferred he reach out to me before answering all media requests. He was also disorganized and took two weeks to send me a contract for his services. It felt like I had to track HIM down to schedule a full intake with his associate. What was most irritating was that he seemed completely unaware that I was entitled to a clerk's hearing. The failure of the police to provide me a clerk's hearing eventually allowed my new attorney to successfully dismiss and expunge my case. However, if I had continued to be represented by Swomley who knows how long I would have continued to languish in the legal system. I would encourage perspective clients to seek out a lawyer who is more punctual, organized, and knowledgable about the law. At least when you throw money into a fire it provides kindling- when you give it to Swomley it does nothing.

Hired Attorney 2021-2023I hired Swomley & Assoc. to file a simple appellate Motion. A Motion that shouldn't have taken more than 2 months to file with the Court. His firm kept delaying my Motion for what they considered more serious legal issues. After several of his personnel left the firm, and his workload was getting too heavy to effectively manage, he terminated my agreement based on a single minor issue. He was clearly looking for an exit ramp to get rid of my case, and to reduce his workload, but not before bilking me out of $40,000. After more than two (2) years (almost 2 1/2), he never filed a single relevant document with the Court, and I am now starting from scratch. I can't say that he is a bad Attorney because he did do any serious legal work, for which he was handsomely paid. He wasted well over two (2) years of my time, with constant promises of "we're just about ready to file your Motion", but that Motion never got filed. He makes promises that he does not keep. I would strongly urge you to look elsewhere for Representation.

How do I choose a lawyer?
Consider the following:
- Comfort Level – Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?
- Credentials – How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?
- Cost – How are the lawyer's fees structured — hourly or flat fee? Can the lawyer estimate the cost of your case?
- City – Is the lawyer's office conveniently located?
Not sure what questions to ask a lawyer?
Here are a few to get you started:
- How long have you been in practice?
- How many cases like mine have you handled?
- How often do you settle cases out of court?
- What are your fees and costs?
- What are the next steps?
Want to check lawyer discipline?
It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:
- Ensure the attorney is currently licensed to practice in your state
- Gain an understanding of his or her historical disciplinary record, if any.
- Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
