Brian has extensive experience in representing contractors and subcontractors in construction disputes. He advises both contractors and subcontractors in drafting and negotiating contracts. If a dispute arises, Brian prosecutes and defends contractors and subcontractors in construction litigation before judges and arbitrators. He also is familiar with the mechanic's lien laws in Illinois and Missouri. The mechanic's lien statutes have numerous requirements and deadlines. Brian works with contractors and subcontractors in perfecting their lien rights and getting them paid for the services and materials they provide on a project.
Brian has extensive experience in Agriculture Law. He has represented farmers and property owners in a wide variety of matters, including the negotiation of utility and pipeline easements, farm management agreements, feed agreements and grain contracts. He has represented farmers in grain disputes both in court and before the National Grain Feed Association.
He also has a regulatory practice, representing farmers and property owners before the Illinois Commerce Commission in a wide range of matters. Brian has challenged utility companies seeking regulatory approval to construct transmission lines and pipelines across farmland. Moreover, Brian has represented property owners before the Illinois Commerce Commission challenging utility companies request to take farmers property through eminent domain.
Brian has represented numerous farmers and property owners in eminent domain proceedings initiated by utility companies, pipeline companies and IDOT. Every farmer and property owner has unique issues and Brian focuses on each client's specific concerns, including the client's property, business and family.
Brian represented business in a variety of commercial disputes. Brian understands that businesses wish to avoid litigation, but if necessary, he zealously fights for their rights. He has tried numerous contract cases to judge and jury and assists businesses in litigation avoidance strategies. He started his practice representing general and subcontractors in Illinois and Missouri and assists them in contract formation, quality control, mechanic's liens and construction defects disputes.
Brian has extensive experience in representation of insurers in coverage litigation involving declaratory judgments, toxic torts, hazardous wastes and construction matters. In addition to litigation, he has consulted with numerous clients on issues of coverage and risk management. Brian has also represented farmers on crop insurance claims.
Brian has litigated cases in Madison and St. Clair counties in Illinois and St. Louis City and St. Louis County in Missouri. He is also licensed in the Central District and Southern District of Illinois as well as the Eastern District of Missouri.
Brian has also advised businesses regarding their corporate and litigation concerns. In addition to addressing clients' litigation concerns, he also has represented clients through alternative dispute resolution, including mediation and arbitration.
