- Aggressively represent and defend clients before federal and state consumer protection agencies, including the Federal Trade Commission and the state attorneys general.
- Interface with federal and state regulatory agencies on behalf of clients to obtain compliance guidance.
- Draft and assist in the implementation of privacy policies. Advise on the collection and use of consumer information.
- Assist clients in responding to data security breaches by recommending internal and external damage control measures and determining whether compliance obligations are triggered.
- Review advertising claims and evaluate substantiation. GuRegulatidance often consists of a risk analysis as to the consequences of going forward with a claim, based on the existing level of substantiation.
- Provide counseling on running compliant sweepstakes and contests.
- Provide compliance guidance regarding direct mail, telemarketing and e-mail campaigns.
- Challenge and defend advertising claims at the National Advertising Division of the Council of Better Business Bureaus.
- Counsel on gift certificate and gift card statutes.
- Draft web site terms of use and coordinate review of licensing agreements.
- Participate in ad hoc projects that involved the former Soviet Union including trademark infringement matters.
Non-Profit Advocacy
Non-profits often require advocacy in front of government and quasi-governmental agencies to promote their issues and policies. I provide services to these organizations as a knowledgeable Washington liaison.
