Railroad Injury Law - Federal Employer's Liability Act
Railroad workers are not covered by state workers' compensation laws. Railroad workers are covered by the Federal Employer's Liability Act (FELA), which was passed by Congress in 1908. Under the FELA, railroad workers can make injury claims against their railroad employers for both specific injuries and for occupational injuries, which can include:
- Rotator cuff and shoulder injuries
- Injuries to the knees, hips, legs, ankles and feet
- Back and neck injuries
- Lung injuries from dust exposure, including asbestosis, mesothelioma cancer and pneumoconiosis
- Cubical tunnel syndrome
- Carpal tunnel syndrome?
- Injuries from inhaling toxic chemicals like solvents and welding fumes
- Cumulative traumatic injuries
Under the FELA, the injured railroad worker has the right to recover the following damages:
- Medical bills not paid by the railroad or the railroad's health insurance
- Future medical bills and expenses
- Past and future lost wages
- Past and future pain and suffering
- Past and future loss of enjoyment of life
Kevin Garrison represents railroad workers in FELA claims throughout the Southwest. If you are a railroad worker who has been injured on the job, you cannot fight large railroad companies like Union Pacific, Burlington Northern Santa Fe, CSX Transportation, and Norfolk Southern on your own. You need the help and expertise of a FELA attorney. It has been our experience that once a railroad worker has been injured on the job, he or she is often hounded by the railroad claim agent to give statements and to quickly settle the case. However, once you have retained the services of an attorney, then the railroad claims agent cannot talk to you about your claim, he must speak with your attorney. If you have been injured on the job as a rail road employee, let an experienced FELA attorney negotiate your case with the railroad claims department. Also, if you cannot return to work at the railroad, we can help you file for your Railroad Retirement Board sickness and disability benefits.
If you think you have been injured on the job at the railroad, contact Kevin Garrison at kevingarrison@inficad.com or call (623) 915-1100 or toll-free (877) 915-1100.

How do I choose a lawyer?
Consider the following:
- Comfort Level
- - Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?
- Credentials
- - How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?
- Cost
- - How are the lawyer's fees structured - hourly or flat fee? Can the lawyer estimate the cost of your case?
- City
- - Is the lawyer's office conveniently located?
Not sure what questions to ask a lawyer?
Here are a few to get you started:
- How long have you been in practice?
- How many cases like mine have you handled?
- How often do you settle cases out of court?
- What are your fees and costs?
- What are the next steps?
Want to check lawyer discipline?
It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:
- Ensure the attorney is currently licensed to practice in your state
- Gain an understanding of his or her historical disciplinary record, if any.
- Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
