Phil is a husband and father to three children. Phil's wife, Wendy, is Of Counsel with Gibbons Legal Group, P.C. Phil has two daughters and a son. Phil's oldest daughter and his son attend college at Indiana University and his youngest daughter is a 8th grader. As a family, they enjoy outdoor activities including boating, hiking and fishing.
Phil is a relentless fighter and a survivor. He has first-hand experience with the issues and worries that come with the unexpected turns that life throws at us. In March 2010, Phil was diagnosed with Stage III Hodgkin's lymphoma, a cancer of the blood. Phil endured multiple biopsies, surgery, and six months of chemotherapy during what he calls "the longest year of his life." Today, the cancer is in remission and Phil is happy and grateful to be a cancer survivor. Nonetheless, Phil will never forget what it feels like to be faced with the question of whether his health would prevent him from being able to work. As a result of his cancer diagnosis and treatment, Phil made the decision to expand his practice to include SSDI benefits. Phil now helps individuals file initial applications and appeals, and represents individuals at administrative hearings.
Phil is an active supporter of the Leukemia and Lymphoma Society, including sponsoring a team for the Indianapolis Light the Night Walk, which raises money to provide patient support services, research and advocacy for leukemia and lymphoma patients.
As an employment lawyer, Phil has substantial experience litigating both federal and state law employment claims, including wage and hour, overtime, wrongful discharge, discrimination, harassment, non-compete and breach of contract actions. Today, the majority of Phil's employment law practice is devoted to representing employees in wage and hour matters. Phil has successfully litigated cases seeking the recovery of unpaid overtime, minimum wages, tips, and other earned pay for thousands of employees. He regularly files lawsuits under the Fair Labor Standards Act and other state wage and hour laws as individual claims and collective actions. Phil has represented cable and satellite installers, call center employees, entertainers, restaurant and other tipped employees, debt collectors, security guards, independent contractors, computer and IT employees, inside salespersons, and mortgage industry employees in wage and hour matters. Phil believes that wage theft is one of the largest problems faced by employees across a broad spectrum of industries and he is known for utilizing aggressive and creative litigation strategies to obtain unpaid wages for his clients.
