Overview
Scott E. Mercer practices primarily in the areas of insurance defense, commercial litigation, construction, employment, and redhibition.
In his insurance defense practice, Mr. Mercer represents insurance companies in a wide range of personal injury and property damage claims.
In construction law, Mr. Mercer represents owners, contractors, and subcontractors in defective construction and breach of contract cases. He provides general advice to contractors on construction law and contract issues. He also represents contractors before the Louisiana Contractors Licensing Board. Mr. Mercer has lectured at continuing education seminars on construction law and construction defect claims.
In employment law, Mr. Mercer represents employers in suits involving employment discrimination, wrongful termination, wage and overtime claims, and non-competition and non-solicitation agreements.
In his commercial litigation practice, Mr. Mercer represents businesses in a wide range of disputes, including breach of contract, fraud, misrepresentation, and unfair trade practices. He represents lenders in the collection of commercial loans. He defends automobile and manufactured home manufacturers in redhibition suits alleging defective manufacture and breach of warranty. He represents commercial landlords and apartment complexes in lease disputes and provides legal advice on leases and landlord / tenant issues.
Mr. Mercer is admitted to practice in all Louisiana state and federal courts. He has successfully argued numerous cases in the trial courts, courts of appeal, and the Louisiana Supreme Court.
Representative Experience
- Successfully argued before the Louisiana Supreme Court in a wrongful death case. See Lemann v. Essen Lane Daiquiris, Inc., 923 So.2d 627 (La. 3/10/06).
- Successfully argued before the Louisiana Supreme Court in a motor vehicle accident case. See Rabalais v. Nash, 952 So.2d 653 (La. 3/9/07).
- Successfully argued before the Court of Appeal on behalf of a general contractor in a construction defect case. See Morton Bldg., Inc. v. Redeeming Word of Life Church, 835 So.2d 685 (La. App. 1 Cir. 10/16/02).
- Successfully argued before the Court of Appeal on behalf of a real estate agent and broker in a negligence claim. See Task v. Gates, 770 So.2d 21 (La. App. 3 Cir. 9/13/00).
- Member of the defense team which represented an employer in numerous employment discrimination suits in federal court alleging sexual harassment; gender, age, and disability discrimination; and unequal pay. See Aucoin v. Kennedy, 2006 WL 2700711 (E.D. La. 9/19/06); Aucoin v. Kennedy, 355 F.Supp.2d 830 (E.D. La. 7/26/04); Safford v. St. Tammany Parish Fire Protection Dist. No. 1, 2004 WL 1196894 (E.D. La. 5/26/04); Rhyce v. Martin, 173 F.Supp.2d 521, (E.D. La. 4/09/01).
