Avoid this woman like the plague!! My sister passed away recently and her ex husband told me Harman-Dempsey wrote her will so I called her to see if she had a copy of the will on file and could represent my sister's estate. She took 3 days to return my call and when she did she was rude and unprofessional. She claimed my sister and her ex-husband had picked up a draft copy of the will and never followed up with her and never paid her. When I told this to my sister's ex-husband (who had remained on good terms with her and was at her bedside in support of their son when she died) he went into his storage and spent a few hours and located the original signed copy of my sister's will. The will was clearly notarized by Nan Harman-Dempsey and had not only her quite legible signature but also was embossed with a notary stamp which embossed her name into the signature page. My ex brother in law also showed me the check he paid her with that bears her endorsement signature for deposit. When I called her back she didn't answer and I left a message advising her that of the above facts I had learned subsequent to speaking with her and said she incorrectly and unfairly maligned my family (and during a time of grief) and acted quite unprofessionally and owed me an apology. I am not holding my breath waiting on this. Subsequent to the above when we contacted a different probate attorney it took them about 10 seconds to locate several aspects of the will which were poorly written such as a confusingly worded succession chain of alternate executors, a badly worded section on trusts for their son were he a minor, etc. So not only is Harman-Dempsey possessed of a poor memory in incorrectly recalling facts about the work she did on my sister's will and very unprofessional in the manner she did so and then refused to apologize for her mistake, she is also a lousy lawyer who doesn't know how to properly write a will.

How do I choose a lawyer?

Consider the following:

  • Comfort Level – Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?
  • Credentials – How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?
  • Cost – How are the lawyer's fees structured — hourly or flat fee? Can the lawyer estimate the cost of your case?
  • City – Is the lawyer's office conveniently located?

Not sure what questions to ask a lawyer?

Here are a few to get you started:

  • How long have you been in practice?
  • How many cases like mine have you handled?
  • How often do you settle cases out of court?
  • What are your fees and costs?
  • What are the next steps?

Want to check lawyer discipline?

It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:

  • Ensure the attorney is currently licensed to practice in your state
  • Gain an understanding of his or her historical disciplinary record, if any.
  • Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
