Smith and firm tax attorneys have been involved in the tax controversy area, representing clients in disputes with the Internal Revenue Service and other taxing agencies over the proper tax treatment of various transactions. Also, John L. Smith has extensive practice in representing individuals charged with criminal tax problems.
Litigation
The firm's litigation specialists have represented clients in court proceedings throughout the United States, including the United States Tax Court. Among the types of matters handled by the group are: contract, commercial, personal injury, insurance, environment, antitrust, and tax liability, including proceedings with the U.S. Department of Justice, and its state counterparts.
Specific Areas of Practice
Antitrust and Trade Regulation
Smith & Helman and their associates have represented clients in government actions brought under the Sherman, Clayton, and Robinson-Patman Acts. In antitrust compliance, we have counseled clients on unfair trade practices, and civil and criminal actions on issues such as price-fixing, and price discrimination.
Domestic Relations Law
Smith & Helman advises, counsels and represents individuals in domestic relations matters involving dissolution of marriage, child custody and support, spousal maintenance and support, division of non-marital and marital assets, paternity and adoption. Tax planning, transfers of real and personal property and structuring of trusts and other legal entities are provided.
Environmental Law
Smith & Helmans partners and associates have represented clients on environmental matters, from regulatory monitoring and compliance to litigation and questions of environmental liability. We have been involved in complex and technical cases under the Clean Water Act, the Clean Air Act, the Toxic Substances Control Act, and state counterparts to federal laws.
Government Agency Representation
Smith & Helman and Ronald L. Cook have been actively engaged in general representation, litigation, negotiations, arbitration and mediation for the State of Kentucky; Jefferson County Kentucky Sheriff's Department; Jefferson County Kentucky Fiscal Court; Kentucky Court of Justice; and 4th, 5th and 6th class cities located in Louisville, Jefferson County, Kentucky.
Health Care Law
Smith & Helman have had a broad-based health care practice representing insurers, medical facilities, health care associations and providers. They have been involved in litigation on health care issues including third-party reimbursement, physician staff privileges, malpractice, antitrust and labor. John L. Smith, personally, has represented a variety of physicians, hospitals, and nursing homes on criminal charges.
Litigation
Smith & Helman is particularly strong in the area of litigation due to the breadth of government experience possessed by many of our attorneys. The firm includes a former U.S. Attorney, and head of a Justice Department strike force on organized crime and racketeering. We routinely litigate complex antitrust, bankruptcy, criminal, employment discrimination, government contracting, labor, domestic relations, medical malpractice, workers compensation, personal injury and tax cases.
Sports Law
Smith & Helman represents high school athletes, college athletes, universities and/or college employees, perspective National Football League players concerning NCAA Rules and Regulations, as well as letters of intent governed by the College Commissioner's Association. In addition, Smith & Helman have participated in hearings before the NCAA Committee, including infractions, as well as mediation with the National Football League.
White Collar Crime
Smith & Helman has a "white collar" criminal defense team specializing in representing clients in pre-indictment investigations before agencies such as the Federal Bureau of Investigation, Department of Justice, Internal Revenue Service, Securities and Exchange Commission and Drug Enforcement Administration; before federal or state grand juries, in jury and court trials; in appeals and other post-conviction relief efforts, including sentence reduction motions and hearings; and before parole and probation agencies. We also counsel clients whose corporate or personal records have been subpoenaed by an investigating agency or grand jury.
