Frank Anthony Brancato was a family friend who my mother had the upmost trust in to prepare her will. It?s heartbreaking to see how he betrayed that trust. My mother?s will clearly states ?I hereby give, devise and bequeath to my son..all of my ownership interests in the home..to be his absolutely and in fee simple.? In spite of this, and instead of following her last wishes, Frank Brancato told me that because he prepared the deed with a survivorship clause, he declared my mothers? last wishes null. As he was the attorney that prepared both that deed and prepared and witnessed my mothers will, he was aware that he would nullify her last wishes. My father, a failed businessman, who has apparently been living off my mother's money for many years, has taken full advantage of the situation by denying the promise he and my mother made to me. Frank Brancato was a willing accomplice in my father?s effort to ?hi-jack? or ?extort? my inheritance by acting as his agent when he told me that my father would ?sell? me my own house for the EXACT amount of a Fidelity IRA my mother left me. I am currently in an estoppel lawsuit with my father but looking for an attorney to hold Frank Brancato responsible for the mental anguish that his lack of disclosure has caused. This has caused my life to become an ongoing nightmare. Any advice would be appreciated. Most recently, when I asked him why he did not tell my mother that her wishes would be nullified when he prepared and witnessed her will, He responded with very hostile and condescending response. He claims privileged communications. This man has no conscience or ethics and seems to revel in the what he has done to my life.

Frank Anthony Brancato is the attorney prepared and witnessed my mothers Last Will and Testament. The property I have resided in since 2004 was purchased with my mother?s funds, under both my parents? names. My parents promised that this property would be signed over and titled to me if I faithfully covered the cost of the mortgage payments. I have no doubt in my mind that Frank Anthony Brancato (who also executed the deed), being a family friend, was well aware of this fact. My mother?s will states to hereby give, devise and bequeath to my son all of my ownership interests in the home to be his absolutely and in fee simple. In spite of this, and instead of following her last wishes to add me as part owner, Frank Anthony Brancato told me that because he prepared the deed with a survivorship clause, he declared my mothers? last wishes null. As he was the attorney that prepared BOTH that deed and my mothers will, he was aware that he would nullify her last wishes. Had he acted competently/ethically and disclosed that fact to my mother, she would have been able to act accordingly by severing the right of survivorship and/or put in writing the promise she and my father made to me. I asked Frank Anthony Brancato why he failed to advise my mother that you would nullify her last wishes. His hostile response was "you are asking about privileged client communications, for which you have no right to receive details. I did not fail to have sufficient discussions with my client concerning her Last Will, and you have no basis to so contend. I am and remain comfortable and confident that [she] knew and understood the scope of the Last Will she signed on [date], and the contents and effects thereof." It is sad that the state of Kentucky allows this shameless, unethical, poor excuse for human being to continue to operate.
