Marc has been practicing law since 1990, when he graduated from the University of Colorado Law School. He began his legal career as an Assistant Public Defender, and went into private practice in 1993. He started his law firm, The Alternative Law Office of Marc Milavitz, P.C., in 1996, with the goal to continue the high quality of legal representation he had learned in his previous employment for all income levels.
During the past thirteen years, Marc has successfully tried numerous felony and misdemeanor jury trials, ranging from traffic and DUI cases to serious and complex felony cases in both state and federal courts. This includes the case of United States v. Brian Gall , a federal case involving a large drug (extasy/extacy) conspiracy. Marc was Mr. Gall's trial attorney and was a key member of the appellate team that won at the United States Supreme Court. This landmark case established an exciting and important rule favoring defendants in federal sentencing law. Due to this experience, Marc has a light level of expertise in federal sentencing issues and has been very successful in obtaining excellent results for both his federal and state clients. Additionally, Marc is a member of NORML and represents many individuals charged with drug crimes, including possession, distribution and cultivation of marijuana, along with cases involving cocaine, crack cocaine, extasy/extacy, LSD, heroin and other illegal drugs. Marc has and is currently representing many diverse individuals including juveniles, college students, professionals and blue-collar workers. He has tried cases and represented clients in Denver, Boulder, Adams, Larimer, Weld and Jefferson counties. As such, he is very familiar with the judges, district attorneys and court systems in the Colorado Front Range community.
Because Marc also represents clients in family law cases, he is intimately aware of the relationship between family law issues and domestic violence, sexual assault on children, or child abuse allegations that involve both the family law courts and the criminal justice system. This expertise is important as often times criminal allegations of domestic violence and child abuse arise during divorce proceedings. Marc has handled many cases where this situation has occurred and has successfully resolved those situations ultimately having the criminal cases either dismissed or resolving the situation with a minimal negative impact on the family law case. Marc has the rare distinction of being the defense attorney in a Sex Assault on a Child case where the District Attorney dismissed the case in its entirety halfway through the prosecution's case, a rare event and a major win for his client.
Marc is approved by the Colorado Alternate Defense Counsel to represents indigent clients in both juvenile and adult felony cases in Adams County, Colorado. Recently, he was appointed to the 10th District Federal Court CJA panel, and is representing clients in federal criminal law cases in Denver, Colorado as well as throughout the country.
