In the natural resources area, we handle complex purchase, sale and financing transactions, particularly those raising mineral development, surface use, and conservation easement issues. We work with clients to identify and comply with the various state and federal environmental and natural resource regulatory regimes, such as those arising out of the Clean Water Act (CAA), the Clean Air Act (CWA), the National Environmental and Policy Act (NEPA), the Federal Land Policy and Management Act (FLPMA), the 1872 Mining Act, the Forest Service Organic Act, the Endangered Species Act (ESA); the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), and the Resource Conservation and Recovery Act (RCRA).
We defend clients before agencies such as BLM, MMS, USFS, EPA, and various state departments of environmental quality. We also provide general corporate advice to our clients. We represent our clients before federal and state courts, arbitration panels, and in mediation sessions throughout the country. In addition to matters relating to natural resources, we assist clients in resolving disputes involving business agreements, supplier contracts, real estate, land use, insurance, employment contracts, shareholder rights, and business torts.
