    The law offices of Michael E Pitts did not do a competent job with the living trust for my family. When he drafted our family's living trust he made the property that of joint tenancy and not community property, which it should have been. Only when we brought the living trust to our new lawyer, did that lawyer note my parents' property in the trust should have been community property (over joint tenancy). The oversight could have cost my family dearly by having to go to probate court. It appears Michael Pitts overlooked that generally, property held as community property with right of survivorship has tax advantages over a joint tenancy. In a joint tenancy, when one spouse sells property that was held jointly prior to the death of the other spouse, a portion of the profit is subject to capital gains tax. Whereas, community property with right of survivorship is not subject to capital gains tax when sold. As a result, the new lawyer had to revise the trust by taking the property out as joint tenants and putting back in the trust as community property. In retrospect, I wish we had avoided his law offices in the first place. His law offices also charged me an exorbitant amount to modify a pre-existing will to include my wife. The version he sent me had various spelling and typographical errors and overall I found his work product sloppy and the cost exorbitant.
