Consulted Law firm 2026A Consumer Alert for Florida Veterans and Citizens About Thoele Drach Law Firm (Tampa, Florida): The Evidence of Professional Negligence Misstated Legal Deadlines: Multiple staff members (Madison Horton and Zachary Caldwell) provided incorrect legal advice regarding the Statute of Limitations. They incorrectly asserted that Florida's 2023 tort reform (HB 837) barred my claim, failing to recognize that the law is not retroactive to causes of action that accrued in 2022. Failure of Supervision: Under Florida Bar Rule 4-5.3, partners are responsible for the conduct of their non-lawyer staff. The fact that two separate employees provided the same incorrect legal information indicates a systemic lack of training and oversight within the firm. Boilerplate Evasion: When confronted with these errors, Managing Partner Justin Seth Drach (A "Veteran") retreated into a "policy decision" to decline the case rather than acknowledging or correcting the fact that his office provided a fellow Veteran (myself a 100% disabled Veteran) with false legal deadlines. "He that speaketh truth sheweth forth righteousness: but a false witness deceit." (Proverbs 12:17) Why This Matters to You: If you have consulted with Thoele | Drach Law and were told your case was "closed," "non-viable," or "expired" due to the 2023 changes in Florida law, verify that information immediately with another attorney. You may have been a victim of the same systemic negligence I encountered. A firm that provides incorrect statutory deadlines to potential clients isn't just being "selective"—they are creating a professional liability that could cost you your civil rights. The truth is documented. If you believe you have been misled by this firm regarding your filing deadlines, do not take their word as the final authority. Seek a second opinion from a firm that prioritizes legal accuracy over administrative "gatekeeping."

How do I choose a lawyer?
Consider the following:
- Comfort Level – Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?
- Credentials – How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?
- Cost – How are the lawyer's fees structured — hourly or flat fee? Can the lawyer estimate the cost of your case?
- City – Is the lawyer's office conveniently located?
Not sure what questions to ask a lawyer?
Here are a few to get you started:
- How long have you been in practice?
- How many cases like mine have you handled?
- How often do you settle cases out of court?
- What are your fees and costs?
- What are the next steps?
Want to check lawyer discipline?
It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:
- Ensure the attorney is currently licensed to practice in your state
- Gain an understanding of his or her historical disciplinary record, if any.
- Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
