Shana Saichek has provided legal advice and litigation services to employee benefit plan sponsors in the public and private sectors since 1980. She has experience with a wide variety of health and welfare, pension and profit sharing, 401(k) plans and 457 plans, apprenticeship, prepaid legal, cafeteria, sick leave/salary conversion, and flexible spending account arrangements. In the past decade, Shana developed the "Retiree Medical TrustTM" concept, which provides funding for a highly tax-favored retiree medical reimbursement plan; she has helped to implement more than thirty tax-exempt trusts for funding these plans. In 2007, Ms. Saichek established the Saichek Law Firm, APC, with a focus on employee benefit trusts for public sector employees, as well as general fiduciary counsel.

From 1993-2007, Ms. Saichek was a partner in the Seattle law firm of Carney Badley Spellman, where she headed the Employee Benefits Group. Prior to that, Ms. Saichek was the Associate Director of Research and Vice President for a national actuarial and benefits consulting firm in New York (1987-1991), where she was responsible for research and analysis of legislative, regulatory and judicial developments at the state and federal level affecting employee benefit plans. From 1980-87, Shana was in private practice with a concentration in multiemployer (Taft-Hartley) employee benefit plans in several industries.

Ms. Saichek is also a frequent speaker and author on employee benefit plan issues.

How do I choose a lawyer?

Consider the following:

Comfort Level
- Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?

Credentials
- How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?

Cost
- How are the lawyer's fees structured - hourly or flat fee? Can the lawyer estimate the cost of your case?

City
- Is the lawyer's office conveniently located?

Not sure what questions to ask a lawyer?

Here are a few to get you started:

  • How long have you been in practice?
  • How many cases like mine have you handled?
  • How often do you settle cases out of court?
  • What are your fees and costs?
  • What are the next steps?

Want to check lawyer discipline?

It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:

  • Ensure the attorney is currently licensed to practice in your state
  • Gain an understanding of his or her historical disciplinary record, if any.
  • Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
