Overview

Mr. Biornstad has significant experience in the areas of civil, commercial, and business litigation. He has worked on cases involving a variety of issues, including breach of contract, breach of fiduciary duty, fraud, limited liability company member and corporate shareholder disputes, business torts, conversion, theft, negligence, theft of trade secrets, anti-SLAPP, real property disputes, construction contract disputes, legal malpractice, civil RICO, personal injury, wrongful death, employment discrimination, wrongful termination, and product defect.

Mr. Biornstad has considerable experience in pre-trial and trial work, making court appearances, arguing motions in federal and state court as well as jury and bench trial experience, arbitrations, and mediations. He has taken and defended numerous depositions and has written appellate briefs to the California Court of Appeal and the U.S. Court of Appeals for the 9th Circuit. Mr. Biornstad has proven experience managing complex discovery from a multinational corporation and other aspects of pre-trial litigation in a case involving numerous experts and parties litigated in both federal multidistrict litigation and state court-coordinated proceedings with tens of millions of dollars at issue. He consistently demonstrates the ability to manage and work through complex issues and proceedings while meeting strict deadlines, providing timely client communication, and providing outstanding results for his clients in demanding and adversarial environments.

Mr. Biornstad graduated magna cum laude from Willamette University College of Law in Salem, Oregon. During law school, Mr. Biornstad worked on the Willamette Law Review as an associate editor and then on the Editorial Board. Mr. Biornstad received the "High Paper Award" for best paper in Appellate Advocacy, Jurisprudence, Property, and Legal Research and Writing. He was a finalist in the First Year Moot Court Appellate Competition and was on the dean's list numerous times, while also receiving a Dean's Scholarship. During his second year, he worked as an extern for the Honorable Robert D. Durham of the Supreme Court of Oregon and the Honorable Susan M. Tripp of the Circuit Court of the State of Oregon, Third Judicial District. Prior to law school, Mr. Biornstad received a Bachelor of Arts degree in History from Brigham Young University in Provo, Utah, where he was on the Dean's List, was an Academic Scholarship Recipient, and played on the Men’s Rugby team.

Before entering private practice, Mr. Biornstad clerked for the Honorable Mark Gibbons at the Supreme Court of Nevada for one year.

Mr. Biornstad is admitted to practice in all California and Nevada state courts, the U.S. District Court for the Central and Southern Districts of California and the District of Nevada, and the U.S. Court of Appeals for the 9th Circuit.
