Overview
Stephen M. Garcia is a senior partner at Garcia & Coman, where he focuses on elder abuse, nursing home neglect, wrongful death, trucking accidents, medical malpractice, insurance bad faith, and products liability litigation. A civil trial attorney since 1994, and previously a criminal trial lawyer, Garcia has devoted his career to representing vulnerable individuals and their families in complex, high-stakes litigation.
Garcia has served as lead counsel in more than 2,500 elder and dependent adult abuse cases and has been involved in matters generating over $1 billion in verdicts and settlements nationwide. He has secured numerous multi-million-dollar results, including some of the largest nursing home verdicts in California history, and has successfully prosecuted and resolved major class actions on behalf of elders and consumers. His work has included precedent-setting appellate advocacy, including participation in significant elder abuse matters before the California Supreme Court.
In addition to his trial practice, Garcia is a frequent lecturer on elder justice and trial advocacy, speaking before judicial, legal, and healthcare organizations. He has served in leadership roles within consumer attorney associations and has testified regarding legislation impacting the rights and protections of elders.
Garcia has been recognized by Lawdragon as one of the “500 Leading Lawyers in America,” was honored as a California Lawyer of the Year (CLAY) award recipient for elder law, and has been repeatedly selected to Southern California Super Lawyers, including recognition among the Top 100. Some lawyers publish comparative information regarding the services that they provide which may be subject to specific comparative communications restrictions.
How do I choose a lawyer?
Consider the following:
- Comfort Level – Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?
- Credentials – How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?
- Cost – How are the lawyer's fees structured — hourly or flat fee? Can the lawyer estimate the cost of your case?
- City – Is the lawyer's office conveniently located?
Not sure what questions to ask a lawyer?
Here are a few to get you started:
- How long have you been in practice?
- How many cases like mine have you handled?
- How often do you settle cases out of court?
- What are your fees and costs?
- What are the next steps?
Want to check lawyer discipline?
It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:
- Ensure the attorney is currently licensed to practice in your state
- Gain an understanding of his or her historical disciplinary record, if any.
- Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
