Overview

Mark Paluch is Counsel to Kesselman Brantly Stockinger LLP. Mr. Paluch is an experienced commercial litigator whose practice has included work on intellectual property, entertainment, advertising, insurance, bankruptcy, employment, real estate, and appellate matters, as well as extensive work on behalf of government agencies. Mr. Paluch has substantial trial experience, having participated in trials in Federal court and the State courts of California and Delaware, in matters involving contract and fraud claims, claims under the California False Claims Act, and claims arising under Federal patent, copyright and trademark law. Mr. Paluch also has extensive experience in pre-trial and post-trial procedures and has worked on numerous appellate matters, including in the Federal Circuit. Mr. Paluch's practice has involved representation of both plaintiffs and defendants.

Mr. Paluch's representations include work defending former corporate directors in an action brought by a trustee in bankruptcy (summary judgment granted in favor of directors; decision affirmed on appeal); representation of a well-known international restaurant chain in a dispute with its franchisees (favorable decision following bench trial); work on behalf of a whistleblower and numerous public agencies in a suit against a manufacturer of parts for public water systems (successful settlement following trial on certain issues), representation of a television network and production studio in an action by the creators of a popular television program (successful settlement following two-month jury trial), representation of a defendant in a copyright and trademark infringement action by fashion industry leaders (mid-trial settlement on favorable terms), and representation of a landlord in an effort to overturn an arbitration award in favor of his tenant (award successfully vacated). Mr. Paluch was part of a successful effort to establish new law on behalf of a whistleblower client in Armenta v. Mueller et al., 142 Cal.App.4th 636 (2006). For his work on the Armenta litigation, Mr. Paluch was nominated for the Public Justice Foundation's 2010 Trial Lawyer of the Year Award. Mr. Paluch has also successfully represented pro bono clients in cases involving disputes over real property and tort claims for personal injuries.

At New York University Law School, Mr. Paluch was a member of the Moot Court Executive Board, where he represented the law school in the National Moot Court Competition and was awarded the prize for Best Oralist at the Northeast Regional Finals. Mr. Paluch holds a Lewis F. Powell Jr. Medal for Excellence in Advocacy (presented by the American College of Trial Lawyers) and, at school, took first place in the Marden Spring Open Moot Court competition. Mr. Paluch was a Robert McKay scholar and served as a staff editor for the Journal of International Law and Politics.

Prior to law school, Mr. Paluch worked as an editor and marketing manager in the book publishing industry in New York City. An avid traveler, Mr. Paluch has visited more than 90 countries. In addition to his law degree, he also has a Master's Degree in Psychology. His various personal interests include theater (particularly the plays of Shakespeare) and college sports.
