Kimberly L. Moore is an attorney at Bold, Polisner, Maddow, Nelson & Judson. She represents individuals, developers, general contractors, product manufacturers and suppliers, trucking companies and trade contractors in litigated matters. Her practice includes resolution of significant damage claims through motions for summary judgment and summary adjudication. She also uses her prior nursing experience in evaluating claimed injuries and taking and defending medical expert witness depositions.

Ms. Moore graduated magna cum laude from the University of California Los Angeles in 1982 with a Bachelor of Science degree in Nursing. She graduated in 1986 from King School of Law at the University of California Davis with a Juris Doctor degree. Ms. Moore is a member of Claims & Litigation Management Alliance (CLM). She attended the 2013 CLM Litigation Management Institute, receiving the Certified Litigation Management Professional (CLMP) designation.

In addition to her law practice, Ms. Moore has been active in the Walnut Creek, California community. She has served on the board of directors for multiple non-profit organizations, including the Center for Human Development and the Northgate Pride Community Foundation.

REPRESENTATIVE MATTERS

  • Represented the manufacturer of a custom trailer with respect to the claims of an individual who claimed to be injured while exiting the living space in the trailer, obtaining the dismissal of the manufacturer from plaintiff’s claims and all cross-complaints for a waiver of fees and costs.
  • Represented trucking companies with respect to injuries claimed by individuals involved in traffic accidents.
  • Represented the manufacturers of products or component parts in both product liability and construction defect matters.
  • Served as second chair in defense of a subcontractor in state court in San Diego in action concerning alleged defects in condominium complex, resolved claims totaling over $17 million for less than $1 million; drafted dispositive motions in defense of subcontractor.
  • Served as second chair in defense of developer and general contractor in state court action in Oakland concerning alleged defects in the construction of a lot for a "spec" home, drafted motions for summary adjudication which resulted in claims totaling more than $10 million being resolved for less than $1 million.
  • Served as second chair in defense of entity which sold "shelf" condominiums in state court action in Oakland concerning alleged defects in units and common areas, drafted motions for summary adjudication which resulted in claims against client being favorably resolved.
  • Served as second chair in defense of a subcontractor in trial in Napa concerning alleged defects in resort complex, defended motion for summary adjudication on the issue of the duty to defend and prevailed on motion for summary adjudication on issue that subcontractor owed no defense or indemnity obligation to the general contractor based upon the indemnity language in the subcontract, ruling resulted in resolution of claims in excess of $500,000 for less than $30,000.
  • Served as second chair in defense of a subcontractor in state court action in Santa Clara County concerning alleged defects in retail and condominium units and adjoining common areas; took depositions of all percipient witnesses and experts.
  • Served as second chair in defense of developer of attached single family housing in state court action in Alameda County; prepared all pre-trial motions and trial briefs, ruling on pre-trial motion resulted in favorable ruling in cross-complaint against subcontractors
  • Represented a non-profit corporation with respect to the claims of an individual who claimed that the non-profit corporation bore liability under a breach of contract theory for the individual’s personal injuries caused by the nonprofit’s employee while acting outside the course and scope of the employee’s employment, obtaining a dismissal on a motion for summary judgment.
