Overview

Linda E. Rosenzweig has been practicing in the area of employee benefits and employment law for more than 40 years. Linda's broad-based practice covers the entire range of employee benefits matters. Linda advises clients on compliance and plan design of tax-qualified, non-qualified and welfare plans, as well as issues arising under ERISA, the Internal Revenue Code, Section 409A, the Multiemployer Pension Plan Amendments Act (MPPAA), COBRA, and HIPAA. She also works with clients to amend their plans and submit voluntary correction applications, implement reductions in force, and deal with service providers, including negotiating contracts. Linda's knowledge and experience also extend to the federal employment discrimination laws, Medicare secondary payer rules, and mergers and acquisitions.

Linda conducts training for in-house staff in charge of plan administration and human resources on various subjects, including EEO issues, fiduciary responsibility, COBRA administration and HIPAA.

Linda represents employers in administrative proceedings and litigation arising under ERISA and federal employment laws, having handled private litigation (including U.S. Supreme Court and federal court cases) on behalf of employers as well as on behalf of the PBGC's Title IV plan termination program.

During her tenure at the PBGC, she represented the agency in significant litigation matters and thereafter became the Executive Assistant to the General Counsel, handling sensitive legal matters and serving as liaison between the agency, Congress, and other federal government agencies.

Linda served for several years as the President of the Greater Washington Metropolitan Area Chapter of the Worldwide Employee Benefits ("WEB") Network. She is a Charter Fellow of the American College of Employee Benefits Counsel.

She co-edited "OFCCP and the Federal Contract Compliance (Copus and Rosenzweig, editors, PLI, 1981); co-authored the Fifth edition of the Pension Answer Book (Panel Publishers, 1989); and authored the COBRA Handbook (Second Edition, Panel Publishers, November 1995).

Linda was the Chair of the Employee Benefits and Executive Compensation Interest Group of the American Bar Association Health Section, and the Section's Liaison to the ABA's Joint Committee on Employee Benefits. In addition, Linda previously served for two terms as the Chair of the Employee Benefits Committee of the ABA's Tort and Insurance Practice Section. Linda was a recipient of the American Bar Association's Edmund S. Muskie Pro Bono Award, which she received for her work as the founder and Director of a Pilot Pension Dispute Resolution Project.

Linda served as Senior Counsel-Benefits and Employment at Keightley & Ashner LLP, the nation's premier PBGC-focused law firm, from 2009 until she joined The Wagner Law Group with the Keightley & Ashner team in January 2022. Before joining Keightley & Ashner, Linda was with several major law firms where her practice covered a broad range of labor, employment, and employee benefits issues, and was also with PBGC and NLRB.
