Overview
Omer N. Farukhi practices in the Firm’s Complex Litigation, Pharmaceutical Products, Toxic Torts & Products Liability, Environmental, Investigations, and White Collar Defense groups where he represents some of the Firm’s core clients consisting of major global pharmaceutical companies, medical device manufacturers, and agricultural companies.
In his civil practice, Mr. Farukhi is actively involved with the representation of major pharmaceutical clients in defense of individual cases in state and federal jurisdictions as well as in multidistrict litigation (“MDL”). In this capacity, he manages several aspects of the discovery process, including drafting pleadings and responses to discovery requests. He also manages a large scale MDL, including the transfer of cases to and from the MDL, the remand of cases from the MDL for trial, and related filings before the Judicial Panel on Multidistrict Litigation. Additionally, Mr. Farukhi is currently part of the defense team representing a global agricultural company in litigation centralized before the United States District Court for the Northern District of California as well was in state courts in California and Missouri. Further, he is responsible for the research and retention of various scientific expert witnesses in preparation for trial. In this realm, he manages several aspects of expert witness development and strategy relating to Daubert hearings and trials. He also has experience with complex litigation matters involving the overlap between federal jurisdiction and Native American tribal jurisdiction.
In his criminal practice, Mr. Farukhi has been involved with the representation of an individual seafarer client in defense of various maritime and environmental criminal liabilities resulting from violations of the Act to Prevent Pollution from Ships. Through his vast contributions to discovery and motions practice, he helped successfully secure the dismissal of a federal criminal indictment in the United States District Court for the District of Columbia. Furthermore, Mr. Farukhi has experience with Fourth, Fifth, and Sixth Amendment issues, specifically including matters involving habeas corpus situations, custody, search and seizure, warrants, Miranda, and jury composition. He also has comprehensive experience with federal sentencing and regularly attends the United States Sentencing Commission’s Annual National Seminar on the Federal Sentencing Guidelines.
Mr. Farukhi’s pro bono practice has included tutoring students at Garrison Elementary School in preparation for Washington, DC’s Geoplunge geography tournament.
Prior to joining the Firm, Mr. Farukhi worked as a Fraud Surveillance Analyst at the NASD (now part of FINRA) in the Market Regulation Department in Rockville, MD, where he conducted investigations of broker-dealers regarding suspicious trading patterns and activity.
Mr. Farukhi earned his degree in Finance with a concentration in Law from Lehigh University in Bethlehem, PA. He received his law degree from The Catholic University of America-Columbus School of Law, where he served as Vice Chancellor of the Moot Court Association and was a member of the Moot Court Association’s National Trials Team. During law school, he served as a “Rule 16” student prosecutor in the Montgomery County State’s Attorney’s Office in Maryland. Also during law school, Mr. Farukhi served as a law clerk at the U.S. Attorney’s Office for the District of Columbia where he assisted with the prosecution of cases involving terrorism and national security.
