Overview

Scott D. Balderston, B.E.E., JD, is a registered patent attorney with comprehensive experience in all phases of intellectual property. In 25 years of practice, Mr. Balderston has developed expertise in areas of patent portfolio management, counseling, and patent prosecution for companies in all stages with a particular interest in working with startup to mid-size companies. Over that time Mr. Balderston has personally prepared and managed more than 500 patent applications, and managed an equal number of prosecution cases. He also actively engages in trademark prosecution and advice, as well as trademark opposition proceedings and related negotiations.


Representative industries in which Mr. Balderston has in-depth knowledge include telecommunications, medical hardware and devices including sequencing platforms, electric power systems, and a variety of computer software. Mr. Balderston has worked in large general practice firms, as well as intellectual property boutiques, prior to joining Symbus.

Mr. Balderston's practice includes significant involvement in IP litigation and related matters. Those experiences include Federal Circuit appeals, Patent Office Re-examination proceedings, and federal district court litigation, as well ceedings before the Trademark Trial and Appeal Board. A number of those matters have involved millions and greater in successful at-stake claims. He also has significant experience conducting licensing transactions on behalf of patent and trademark holders, as well as licensees.


In addition, Mr. Balderston brings to his clients wide-ranging knowledge of corporate and other matters such as federal bankruptcy and valuation proceedings on behalf of institutional investors, as well as corporate financings and mergers and acquisitions in which IP has played a significant part.


Mr. Balderston has extensive experience supporting clients ranging from individual patent applicants, startup companies, expansion-stage entities, universities, privately held companies, and large-scale institutional portfolio holders, including Fortune 100 and 500 companies and other large international entities.
