Attorney Information
Overview
Michael R. Band is a former chief assistant state attorney (Miami-Dade State Attorneys Office) and served as a federal prosecutor in the Southern District of Florida.
Mr. Band has been called upon to represent a sitting United States Congressman, the elected Public Defender, and numerous other public officials. He has been asked by judges and leading law firms to represent and counsel clients. He has served and continues to serve municipalities, government officials, and the Miami Dade School Board in the representation of institutions and individuals under investigation or to advance their positions before courts or Ethics Commissions.
Michael is known for his tenacity, innovation, and commitment to his clients. Recognized by his peers he has served in leadership positions with the Florida Bar as chair of its Criminal Law Section and three-times chair of its Judicial Nominating and Procedure Committee. Closer to home he has served as chair of the Dade County Bar Association's Criminal Courts Committee and Judicial Poll Committee as well as on its Board of Directors. Michael has served on the boards of Legal Services of Greater Miami, Florida Association of Criminal Defense Attorneys – Miami, and as chair of the Miami Beach Housing Authority and his synagogue.
Michael was appointed by Florida’s governor to the Eleventh Judicial Circuit Nominating Commission. His representation/advocacy has extended internationally to counseling clients and has successful argued to the Commission De Controle Des Fichiers De L’O.I.P. (Interpol) for the removal of a client from Interpol’s Red Notice List. He has counseled and advocated for a host of Fortune 100 corporate clients: from ATT through Waste Management.
Recognizing that victory for his client may come through skillful negotiation before arrest, that is, convincing the prosecutor that the case may lack evidence or the legal support before an indictment is returned, or charges brought forward or after an arrest or the handing up of an indictment at trial. Michael has tried in excess of one-hundred jury trials. In his home district, as a federal prosecutor, he led the trial team in one of the district's longest trials (approximately five and one-half months) returning verdicts of guilty against twelve defendants on charges of RICO, CCE, corruption, drug and homicide counts; and, as a defense attorney in a four month trial where the jury acquitted his client of two murder counts but finding him guilty of conspiracy - later overturned on appeal. He has appeared in courts from Seattle to Key West, New York to Los Angeles and from Chicago to Houston providing aggressive and balanced representation.
Finding solutions. Solving problems. Out-of-the-box thinking. These are the hallmarks of Michael's career. Named in Florida Trend’s Legal Elite, Super Lawyers and AV Rated by Martindale-Hubbell, Michael stands at the forefront of the legal profession.

How do I choose a lawyer?
Consider the following:
- Comfort Level – Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?
- Credentials – How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?
- Cost – How are the lawyer's fees structured — hourly or flat fee? Can the lawyer estimate the cost of your case?
- City – Is the lawyer's office conveniently located?
Not sure what questions to ask a lawyer?
Here are a few to get you started:
- How long have you been in practice?
- How many cases like mine have you handled?
- How often do you settle cases out of court?
- What are your fees and costs?
- What are the next steps?
Want to check lawyer discipline?
It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:
- Ensure the attorney is currently licensed to practice in your state
- Gain an understanding of his or her historical disciplinary record, if any.
- Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
