Overview

Victoria Diaz is an associate attorney at Zarco Einhorn Salkowski, P.A., where she focuses her practice on franchise and complex commercial litigation. She represents franchisees, area developers, business owners, and other commercial clients in disputes involving franchise agreements, contractual rights, business relationships, and other high-stakes commercial matters.

Victoria approaches litigation with an emphasis on persuasive writing, meticulous preparation, and developing a clear strategy around both the legal and business issues at stake. She has experience handling matters through multiple stages of litigation, including pre-suit investigation and strategy, emergency and preliminary injunctive proceedings, complex discovery, depositions, expert-related issues, dispositive motion practice, mediation, trial preparation, and appellate briefing. She regularly works on matters requiring the analysis of extensive contractual histories, business records, communications, and financial information and focuses on distilling complicated factual records into clear and compelling legal arguments.

A significant portion of Victoria’s practice involves disputes arising from franchise relationships. Her experience includes matters concerning franchise termination and nonrenewal, enforcement of franchise agreements, pre-sale representations and franchise disclosure issues, restrictive covenants, and claims involving breach of contract, fraud, misrepresentation, and related business torts. She has also worked on disputes involving trademark and post-termination issues, as well as matters requiring expedited relief where the parties’ contractual and operational rights are immediately at stake.

Victoria brings a business-oriented perspective to her legal practice. Before becoming an attorney, she spent several years in business and operations roles. Her undergraduate education in business administration and marketing, together with her professional experience before law school, informs the way she approaches commercial disputes. She strives to understand not only the governing contracts and legal principles, but also how a dispute affects a client’s operations, financial interests, and broader business objectives.

Victoria earned her J.D. from the University of Miami School of Law, where she distinguished herself in trial advocacy, legal writing, and academics. She was a member of the nationally recognized Miami Trial Team and competed in national trial and pretrial advocacy competitions. Her advocacy achievements earned her induction into the Order of Barristers, a national honor recognizing excellence in courtroom advocacy. She also received the Best Student Casenote Award and numerous academic awards, including several CALI Excellence for the Future Awards, the Director’s Book Award in Litigation Skills, and multiple Dean’s Certificates of Achievement Awards.

Victoria has also contributed to scholarship and writing concerning developments in franchise law and the franchise industry. She is fluent in Spanish and proficient in Portuguese.

When viewing a listing, consider the state advertising restrictions to which lawyers and law firms must adhere, as well as our FindLaw.com Legal Directory disclaimer. Some lawyers publish comparative information regarding the services that they provide which may be subject to specific comparative communications restrictions.

How do I choose a lawyer?

Consider the following:

  • Comfort Level – Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?
  • Credentials – How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?
  • Cost – How are the lawyer's fees structured — hourly or flat fee? Can the lawyer estimate the cost of your case?
  • City – Is the lawyer's office conveniently located?

Not sure what questions to ask a lawyer?

Here are a few to get you started:

  • How long have you been in practice?
  • How many cases like mine have you handled?
  • How often do you settle cases out of court?
  • What are your fees and costs?
  • What are the next steps?

Want to check lawyer discipline?

It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:

  • Ensure the attorney is currently licensed to practice in your state
  • Gain an understanding of his or her historical disciplinary record, if any.
  • Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
