Overview

Mr. Asselta exclusively focuses his practice to the area of education law issues and over the last ten years has helped to shape this new specialty. Mr. Asselta began his career working for a defense firm that exclusively dealt with criminal appeals and post-conviction criminal litigation. Mr. Asselta has prepared briefs and motions concerning major drug trafficking crimes, criminal conspiracy, and financial crimes, to name a few. He is also an experienced litigator, having tried numerous matters. Mr. Asselta has represented clients in Florida and New Jersey and in numerous federal courts of appeals.

Mr. Asselta's education law practice includes representing the interests of students facing expulsion, college and graduate students throughout the United States facing academic integrity or conduct issues, and fighting for Florida school teachers facing action by their districts and the Florida Department of Education.

For nearly ten years Mr. Asselta represented a public school district, giving him great insight into the process and procedures a school utilizes in dealing with student and teacher disciplinary issues. This opportunity has given Mr. Asselta a unique understanding of the challenges that students face and how the school approaches and handles these challenges. Mr. Asselta's extensive involvement in academic integrity and conduct hearings with colleges and universities has given him unique insight and experience that many other practitioners simply do not have. A critical review of documents and meticulous hearing and appeals preparation are but a few of the ways Mr. Asselta ensures that his clients are provided with the level of services and care that each deserves.

Richard grew up in New Jersey and attended college in Washington, D.C. He attended law school in South Florida where he served as an Associate Editor of his school's Law Review. Upon graduation Richard worked for a firm that specialized in federal appellate and post-conviction law. While there, he assisted in the preparation of appellate briefs and motions in federal courts throughout the country. He then worked on a variety of complex civil matters and represented a public school district.

How do I choose a lawyer?

Consider the following:

  • Comfort Level – Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?
  • Credentials – How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?
  • Cost – How are the lawyer's fees structured — hourly or flat fee? Can the lawyer estimate the cost of your case?
  • City – Is the lawyer's office conveniently located?

Not sure what questions to ask a lawyer?

Here are a few to get you started:

  • How long have you been in practice?
  • How many cases like mine have you handled?
  • How often do you settle cases out of court?
  • What are your fees and costs?
  • What are the next steps?

Want to check lawyer discipline?

It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:

  • Ensure the attorney is currently licensed to practice in your state
  • Gain an understanding of his or her historical disciplinary record, if any.
  • Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
