Attorney Information

Overview

Carl M. Schultz focuses on civil litigation and trial work, particularly in the areas of medical malpractice, healthcare, and general negligence. He has extensive experience defending hospitals, nursing homes, and individual healthcare professionals in professional malpractice matters. He has also represented clients before the Illinois Department of Financial and Professional Regulation, and in various Federal and State healthcare fraud investigations.

Mr. Schultz has successfully represented healthcare clients in obtaining favorable results at mediation, pre-trial settlement conference and trial. Recently, Mr. Schultz obtained a defense verdict in favor of a nursing home in McHenry County Illinois. Plaintiff alleged violations of the Illinois Nursing Home Act arising from a resident who fell and fractured his hip. The winning defense was that the nursing home staff properly followed policy and regulations requiring the least restrictive environment. The jury agreed with the defense and found in favor of the nursing home that there were no violations of the Act. Plaintiff’s post-trial appeal was denied and the defense verdict affirmed.

Mr. Schultz is a regular speaker on topics in healthcare law including presentations at the Chicago Risk Management Society, Illinois Defense Counsel, Chicago Bar Association, and presentations to the staff of various clients.

How do I choose a lawyer?

Consider the following:

  • Comfort Level – Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?
  • Credentials – How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?
  • Cost – How are the lawyer's fees structured — hourly or flat fee? Can the lawyer estimate the cost of your case?
  • City – Is the lawyer's office conveniently located?

Not sure what questions to ask a lawyer?

Here are a few to get you started:

  • How long have you been in practice?
  • How many cases like mine have you handled?
  • How often do you settle cases out of court?
  • What are your fees and costs?
  • What are the next steps?

Want to check lawyer discipline?

It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:

  • Ensure the attorney is currently licensed to practice in your state
  • Gain an understanding of his or her historical disciplinary record, if any.
  • Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
