Overview

Sam Morgan’s law practice focuses on advising and representing employees in the broad range of employment law matters that arise under state or federal law. His practice is mostly employment rights litigation and individual employees who have been wrongfully discharged from their jobs. This includes individuals with employment contracts and those who have experienced illegal discrimination on the basis of their age, race, gender, protected disability, religious beliefs, or veterans status. It also includes employees who have been subjected to illegal retaliation as whistleblowers or because they have engaged in some other legally protected activity. Sometimes these clients have experienced sexual, racial or ethnic-based harassment and/or have been discharged in retaliation for objecting to, reporting or complaining about that harassment. Mr. Morgan handles cases for individuals both in the private sector and in public sector employment.

Many times, Mr. Morgan's clients have been offered severance or separation agreements, which need to be evaluated as an alternative to pursuing a lawsuit. Often, these severance agreements have an impact on equity ownership, including stock option or grant awards, or continued membership in the company, and sometimes the termination is part of a campaign of minority shareholder/member oppression. Other clients have non-compete agreements that may stand in the way of their best, next employment opportunity, or they may have an unpaid-wages claim, ranging from unpaid sales commissions to unpaid overtime pay due to misclassification in violation of the Fair Labor Standards Act.

​Mr. Morgan's jobs as a lawyer were with an insurance defense firm, and then a management-side, only labor and employment litigation firm, and he uses that background, perspective and experience in evaluating cases and developing strategies for litigation and settlement. He also has numerous long-standing management-side clients to whom he provides advice and counsel on workforce management issues, such as disciplinary action, investigations of employee misconduct, development and implementation of employee policies and procedures, and representation in defending against employee and governmental agency claims. ​

Mr. Morgan has represented clients at all levels of organizations in a variety of industries, including the automotive industry, manufacturers’ representatives, health care systems and medical practices, advertising, media, banking and financial services, high tech, gaming and casinos, restaurants and hospitality, spirits and wine businesses, grocery and retail, and construction. He also has significant experience with public sector employment and employee rights that arise under the United States Constitution and various federal and state statutes. While he is located and licensed in Michigan, as a lawyer that frequently litigates federal civil rights claims in federal courts, Mr. Morgan has handled cases in several other states, including Ohio, Indiana, Illinois, Wisconsin, New York, Delaware, Florida and Arkansas.
