Attorney Information
Overview
Andrew M. Malzahn is a partner at Dady & Gardner, P.A., where he represents franchisees and dealers nationwide in all aspects of their relationships with franchisors and manufacturers, from reviewing and negotiating franchise agreements before clients enter into the contractual relationship, to, when necessary, representing franchisees and dealers in various disputes (such as deceptive and fraudulent franchise sales, state and federal franchise registration and disclosure violations, encroachment, non-compete violations, and unlawful terminations) in state and federal court and arbitration. Andrew also represents several franchisee associations, from organization and formation, through tackling and resolving issues and disputes on a system-wide basis.
Andrew is an editor for the American Bar Association's Franchise Law Journal, and he has been named a “Rising Star” by Super Lawyers Magazine and a “Legal Eagle” by Franchise Times every year since 2020.
Andrew is driven to represent and fight for franchisees, dealers, and distributors, who frequently find themselves on the other side of the table from parties with much greater power and resources. Andrew's philosophy is to provide creative, efficient, and effective representation to meet his clients' business objectives.
Andrew will gladly speak to prospective franchisee and dealer clients at no initial charge to determine whether he and his colleagues can be of service.

How do I choose a lawyer?
Consider the following:
- Comfort Level – Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?
- Credentials – How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?
- Cost – How are the lawyer's fees structured — hourly or flat fee? Can the lawyer estimate the cost of your case?
- City – Is the lawyer's office conveniently located?
Not sure what questions to ask a lawyer?
Here are a few to get you started:
- How long have you been in practice?
- How many cases like mine have you handled?
- How often do you settle cases out of court?
- What are your fees and costs?
- What are the next steps?
Want to check lawyer discipline?
It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:
- Ensure the attorney is currently licensed to practice in your state
- Gain an understanding of his or her historical disciplinary record, if any.
- Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
