Overview
Rodney M. Zerbe is a counsel with Crowell & Moring's New York City office. Rodney has litigated a broad range of complex commercial litigation matters, with a concentration in the defense of insurance brokers and reinsurance intermediaries on professional malpractice claims.
Rodney has twenty-five years of large law firm experience, during which he has successfully defended insurance brokers and intermediaries on errors and omissions claims involving placement of commercial general liability, directors and officers liability, property and casualty, marine protection and indemnity, builders’ risk, business interruption and loss portfolio transfer insurance, and facultative and treaty reinsurance placements. Rodney has also litigated numerous complex commercial disputes, including defense of federal securities fraud, RICO and shareholder derivative actions, breach of fiduciary duty and shareholder disputes involving closely-held corporations, unfair trade practices claims, restrictive covenant and non-compete litigation, claims for breaches of commercial representation and warranty agreements, defense of loan servicers on claims relating to collateralized debt offerings, accountants' malpractice liability, partnership disputes, foreign sovereign distressed debt recovery litigation, and other contractual and commercial disputes.
Rodney has handled appellate arguments before the United States Court of Appeals for the Second Circuit and the Appellate Division of the New York State Supreme Court and has conducted arbitrations of commercial disputes in proceedings before the American Arbitration Association, ARIAS and the ICC.
