Attorney Information

Overview

Philip W. Gaines has been practicing law in Mississippi since 1986, having worked primarily in the field of insurance defense with two prominent firms in Jackson, where he built a reputation as a top-level trial and appellate litigator and a fair and effective Mediator and Arbitrator. He specialized in significant insurance claims processing and bad faith defense, while still also maintaining a voluminous personal injury trial schedule in State and Federal Courts throughout Mississippi. Philip still has a substantial defense practice, but he now primarily represents individual and business claimants. He is also especially hired by other attorneys to assist with particular litigation cases or matters involving insurance or other issues for which he has special expertise. Philip has tried over 200 jury trials, with an emphasis on insurance claim, automobile, personal injury, bad faith, and trucking cases. He has helped parties resolve hundreds of cases as a Mediator and Arbitrator, with an emphasis in his ADR practice being on personal injury, insurance, bad faith, trucking, construction, employment, professional malpractice, and nursing home disputes. He also has experience and expertise in state administrative and board matters. For several years, Philip served as the Court Liaison for the Mississippi State Hospital and coordinated the forensic processing of criminal defendants with alleged mental illness issues. Philip has been selected for leadership positions in numerous bar and community associations, as well as in his church. He was President of the Jackson Young Lawyers Association and the Mississippi Law Institute. He was Chair of the Mississippi Bar Alternative Dispute Resolution Section and The University of Mississippi Lamar Order. He presently serves on the Mississippi State Hospital Institutional Review Board.

How do I choose a lawyer?

Consider the following:

  • Comfort Level – Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?
  • Credentials – How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?
  • Cost – How are the lawyer's fees structured — hourly or flat fee? Can the lawyer estimate the cost of your case?
  • City – Is the lawyer's office conveniently located?

Not sure what questions to ask a lawyer?

Here are a few to get you started:

  • How long have you been in practice?
  • How many cases like mine have you handled?
  • How often do you settle cases out of court?
  • What are your fees and costs?
  • What are the next steps?

Want to check lawyer discipline?

It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:

  • Ensure the attorney is currently licensed to practice in your state
  • Gain an understanding of his or her historical disciplinary record, if any.
  • Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
