Attorney Information

Overview

A native of Mississippi, Benjamin N. Philley was born in Jackson, Mississippi and grew up in Grenada, Mississippi and the Mississippi Delta. Ben is one of the founding shareholders of Kilpatrick & Philley, Attorneys at Law. He received his Bachelor's Degree in Business and Finance from the University of Mississippi in 1998 and his Law Degree from the Mississippi College School of Law, where he was an active member of Law Review. While in school, Ben clerked for law firms specializing in both personal injury litigation and civil defense.

Upon graduation from law school, Ben became an associate with Wise Carter Child and Caraway, where he defended cases involving major railroad companies, including Amtrak, Illinois Central Railroad Company, and Kansas City Southern Railroad Company. Ben also represented the defense in complex litigation involving claims related to medical malpractice, automobile accidents, and nursing home abuse.

While Ben is now 100% devoted to serving severely injured individuals, his experience in the defense of litigation is invaluable in obtaining favorable results for his clients as he knows how the other side works. Ben is committed to reaching the best possible result for his clients.

Currently, Ben is a personal injury attorney who devotes his practice exclusively to the representation of severely injured victims as a result of someone else's negligence. Although Ben has a wide spectrum of personal injury litigation, he emphasizes his practice in the area of automobile accidents, trucking accidents, medical malpractice, wrongful death, defective pharmaceuticals/medical devices, nursing home abuse, railroad crossing accidents, and Federal Employers Liability Act (FELA) claims.

Ben is married to Melissa Wise Philley formerly of Brookhaven, Mississippi. They have two daughters, Libby Lane and Layla. He enjoys hunting, fishing, water skiing, wakeboarding, playing golf, and is an avid Ole Miss fan. He, along with his wife and daughters, attend Broadmoor Baptist Church in Madison, Mississippi.

How do I choose a lawyer?

Consider the following:

  • Comfort Level – Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?
  • Credentials – How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?
  • Cost – How are the lawyer's fees structured — hourly or flat fee? Can the lawyer estimate the cost of your case?
  • City – Is the lawyer's office conveniently located?

Not sure what questions to ask a lawyer?

Here are a few to get you started:

  • How long have you been in practice?
  • How many cases like mine have you handled?
  • How often do you settle cases out of court?
  • What are your fees and costs?
  • What are the next steps?

Want to check lawyer discipline?

It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:

  • Ensure the attorney is currently licensed to practice in your state
  • Gain an understanding of his or her historical disciplinary record, if any.
  • Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
