Consulted Attorney 2022I am a professional that specializes in cross border tax work. I have a common client with Kevin. The client is a Canadian with US business interests. Kevin's focus on "helping" the client focused on avoiding US estate tax and failed to consider any income tax obligations. As a result of Kevin's repeated efforts to try to avoid US estate tax Kevin tried to advise putting the client's investment in a corporation. If the client's investment appreciated (which was Kevin's concern) it would have exposed the client to a tax on sale of the US business in the corporation to over 60%, compared to a 40% estate tax rate. If Kevin doesn't realize that his planning exposes the client to high tax rates there is clearly a problem. This is the second time an attorney from Hodgson Russ LLP gave poor advice to a client of mine. The first time the attorney acknowledged the advice provided was tainted after being challenged, but wouldn't change the advice. I would not recommend this firm.
