Overview
Andrew T. Miltenberg is the managing member of the litigation practice at the New York City law firm of Nesenoff Miltenberg, LLP. He is a graduate of Emory University and Brooklyn Law School, and regularly appears before the Courts of the State of New York, as well as the United States District Courts for the Southern and Eastern Districts of New York. He often appears pro hac vice in numerous other state and federal courts.
With more than three decades of experience as an attorney, Andrew has distinguished himself as a versatile and passionate litigator, concentrating his practice in areas including: complex commercial litigation and business torts, shareholder and partnership disputes; real estate litigation; fraudulent conveyance/alter ego and successor liability claims. Andrew has also successfully handled high stakes partnership and business, employment matters, defamation, and complex internet and First Amendment issues.
Currently, Andrew is representing a significant number of college students falsely accused of sexual assault on American college and university campuses. Andrew has been widely quoted in the national media on the need for these defendants to be afforded due process under the law. Most recently, he was profiled in The New York Observer, and his work was the subject of articles in The New York Times and Buzzfeed, which referred to him as the "go-to attorney for students accused of sexual assault". He has mounted a vigorous defense of students who have faced suspension or expulsion from some of the country's best known colleges and universities. USA Today noted that Andrew "is one of a few [lawyers] specializing in this emerging area".
Respected by his legal peers, Andrew is frequently sought out by other attorneys to serve as trial counsel, as he is viewed as a consummate professional aggressive in the courtroom, and maintains a steady and balanced approach. Andrew has tried numerous matters to verdict in both state and federal courts, as well as before arbitration panels.
Andrew has an exceptional understanding of complex business issues, which serves him well in guiding his corporate and real estate clients through critical strategic decisions. Andrew, with an admitted weakness for underdogs, embraces the practical reality that sometimes the best results come with the avoidance of litigation.
