In the real estate litigation context, Weitzman represents developers, landlords and property owners in matters involving commercial and residential landlord-tenant disputes, guaranty enforcement, Yellowstone injunctions, breach of contract of sale, class action rent overcharge claim, partition, and condominium and co-op disputes.


Weitzman also has significant experience in handling employment-related disputes, such as claims of workplace discrimination and harassment, wrongful termination, wage and hour violations, breach of restrictive covenants, and breach of employment agreements; and complicated tort cases arising from products liability, premises liability, general liability, and construction site defects, to difficult insurance coverage disputes.


Weitzman's client base ranges from individuals to Fortune 500 companies. Additional experience includes drafting and arguing motions, taking and defending depositions, and negotiating settlements in matters pending in both state and federal courts, as well as before various administrative tribunals and government agencies.


Prior to joining Rosenberg & Estis, Weitzman was an Associate with Kishner Miller Himes P.C.

• Represented a commercial landlord in the granting of summary judgment against individual guarantors of a commercial lease claiming protection under New York City's "Guaranty Law" where the tenant entity subleased the commercial space

• Represented a residential landlord in dismissal of an Article 78 proceeding brought by a tenant, and denial of a subsequent appeal by the tenant, seeking to reverse a decision by the DHCR denying the tenant's rent overcharge claims

• Represented a commercial landlord in partial dismissal of counterclaims by a commercial tenant sounding in fraud, constructive eviction, and breach of the covenant of quiet enjoyment

• Represented both developers and condominium/cooperative boards involving claims of construction defects in newly constructed buildings

• Represented both property owners and contractors on a construction project in lien foreclosure actions regarding claims of unpaid work

• Represented both property buyers and sellers in misrepresentation cases asserting active concealment of latent construction defects

• Represented real estate brokers in breach of contract cases stemming from the failure to pay a commission under the brokerage agreement

• Represented property owners in litigation asserting nuisance claims arising from faulty construction

• Represented a financial investment company in dismissal of a complaint for sexual discrimination brought by an executive employee before the New York State Division of Human Rights

• Represented a Florida-based corporation and its owner in dismissal of a complaint brought in New York state court for breach of contract, stemming from a sales and marketing agreement that never came to fruition

• Represented a company that was victimized in a Ponzi-type scheme of selling secondary-market life insurance policies to multiple parties, winning summary judgment on policy ownership and therefore entitling the company to recover its equity

• Represented several local New York City businesses in defending against claims of discrimination (disability, religion, race, sex, etc.) in places of public accommodation
