Employment Discrimination
As a worker, you have a wide range of protections on the job, but your employer may not recognize them. Among other things, you’re entitled to work in a place free from discrimination, harassment, and retaliation based on protected characteristics such as your race or sex.
Statutes that protect you that are recognized as strong anti-discrimination laws across the country include the New York State Human Rights Law and the New York City Human Rights Law. There are several federal anti-discrimination laws, most of which are enforced by the Equal Employment Opportunity Commission (EEOC). When you have a complaint of discrimination under one of the federal laws, Mr. Randall and our other attorneys will need to file a charge with the EEOC, which will investigate and perhaps, mediate the claim. Only after they’ve had this opportunity will they send you a Notice of Right to Sue.
Damages Mr. Randall may be able to recover on your behalf if our legal team is successful in your lawsuit include compensation for losses such as emotional distress, back pay, front pay, and out-of-pocket expenses. In some cases, it may be appropriate to seek your reinstatement in a position. When your employer’s misconduct has been egregious, we may be able to request punitive damages, which are damages intended to punish and deter.
