Overview
Madilyn (Madi) Maruna is a Shareholder at Cavitch Familo & Durkin, focusing her practice in the areas of employment and commercial litigation. Madi is uniquely positioned to represent both closely held businesses as well as employees in matters regarding Title VII (employment discrimination and retaliation), the Americans with Disabilities Act (ADA), the Family Medical Leave Act (FMLA), the Fair Labor Standards Act (FLSA), and Ohio Revised Code 4112. With experience representing both employers and employees, Madi has gained a unique litigation perspective that allows her to offer creative solutions for her clients. She also has significant experience representing closely held businesses and individuals in non-compete matters, class/collective actions, commercial litigation, contract disputes, probate litigation, partnership disputes, and real estate disputes.
Her experience also includes regularly representing employers in administrative investigations and proceedings involving the Equal Employment Opportunity Commission (EEOC), the Ohio Civil Rights Commission (OCRC), the Department of Labor (DOL), the Ohio Department of Commerce (Wage and Hour Division), the Ohio Department of Job and Family Services (ODJFS – Ohio Unemployment), and other administrative agencies.
Madi spends much of her time counseling clients to keep them out of litigation by drafting comprehensive employment agreements, non-compete and non-solicitation agreements, policies and agreements to protect confidential information and trade secrets, as well as employee handbooks and operating policies.
Madi earned her Juris Doctor from Cleveland-Marshall College of Law, magna cum laude, and her undergraduate degree in Marketing, cum laude, with a minor in Entrepreneurship, from John Carroll University. Before law school, Madi worked for a financial compliance firm in Cleveland, Ohio, and a China-based manufacturer. Throughout law school, Madi was a member of Cleveland-Marshall’s flagship law review journal and externed for the Cleveland-Marshall Civil Litigation Clinic, where she assisted with representing clients in immigration and unemployment matters. Madi also served as a law clerk for Jackson Lewis, P.C., and Tittle & Perlmuter.
Giving back to the Cleveland community is important to Madi. She volunteers her time as the President of the Cleveland chapter of the Salvation Army’s young professional group, Echelon. She also serves on the National Echelon Leadership Council, which oversees all Echelon chapters nationally. Madi is a dog lover and a board member of One Health Organization, an organization promoting the human/animal connection by providing veterinary vouchers to low-income pet parents in Northeast Ohio. She is also very involved with the Cleveland Animal Protective League. In her spare time, Madi enjoys spending time with family, practicing yoga, cooking, and relaxing with her dogs, Hendrix and Intro.

How do I choose a lawyer?
Consider the following:
- Comfort Level – Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?
- Credentials – How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?
- Cost – How are the lawyer's fees structured — hourly or flat fee? Can the lawyer estimate the cost of your case?
- City – Is the lawyer's office conveniently located?
Not sure what questions to ask a lawyer?
Here are a few to get you started:
- How long have you been in practice?
- How many cases like mine have you handled?
- How often do you settle cases out of court?
- What are your fees and costs?
- What are the next steps?
Want to check lawyer discipline?
It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:
- Ensure the attorney is currently licensed to practice in your state
- Gain an understanding of his or her historical disciplinary record, if any.
- Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
