Overview

Max Dehn is a shareholder with Cavitch, and focuses his practice on business and employment litigation and counseling. He has represented clients in a variety of areas, including employment discrimination, wage and hour matters, non-compete litigation, business contract disputes, and class action defense in state and federal courts, as well as arbitration forums.

Max co-chairs the firm’s monthly employment law luncheon, and also provides counseling to business clients regarding their employment practices. Max has presented lectures to attorneys, business owners and human resources professionals on topics including non-compete contract litigation, and the Fair Labor Standards Act (the “FLSA”).

Max has also worked in successfully defending numerous class and collective actions. These include FLSA collective actions, Ohio Consumer Sales Protection Act class actions, and several large entitlement-based class actions brought against State of Ohio agencies, some of which were litigated over the course of ten years or more.

  • Defend and prosecute numerous Fair Labor Standards Act and other wage and hour matters, including collective actions, in Federal and state courts;
  • Defend and prosecute many non-compete and related post-employment disputes;
  • Defend and prosecute business litigation matters in multiple states, including Ohio, Michigan, Minnesota, Florida, Illinois, and Texas;
  • Defend and prosecute claims arising from business and partnership dissolution, sale, and break-up;
  • Defend and prosecute a breadth of discrimination and retaliation matters in Federal and state courts;
  • Defend business clients in matters concerning employment and accommodations under the Americans with Disabilities Act and related state statutes;
  • Serve as lead counsel in numerous matters including jury trials, bench trials, and a broad variety of judicial and administrative hearings.
  • Manage state and federal investigations, including those conducted by the Department of Labor, the Equal Employment Opportunities Commission, and the Ohio Civil Rights Commission, related to claims under Title VII, the Fair Labor Standards Act, and various state and federal statutes;
  • Draft a breadth of business agreements, including executive employment agreements, sale-of- goods contracts, post-employment agreements, executive and key-man retention agreements, and similar documents; and
  • Manage and direct ongoing compliance audits for business clients to ensure compliance with state and federal employment and wage and hour laws.
