    Hired Attorney 2019
I hired Dan Spector (at his rate of $500/hr) to represent me and my family involving a case of undue influence and elderly abuse. My decision to retain him was based on 2 factors: 1) his Super Lawyer rating and 2) a referral from a professional colleague. I was involved in a big case against a multinational company several years ago and retained a Super Lawyer who was terrific and won our case. Unfortunately, this was not the case with Dan. I setup a consultation call with Dan to discuss my case. Prior to the call, I sent him an email with the details. During the consultation call, Dan essentially paraphrased my email back to me. Towards the conclusion of our discussion, he told me we had a strong case and despite wanting to put odds on our chances for success, he guesstimated 70%. He also advised me that he didn't write letters, he litigated. If the opposing party wanted to talk, he would certainly take their call. I was impressed with the attitude as we were going to need an aggressive attorney to successfully pursue our claims. Unfortunately, more than $10,000 later, Dan was unable to accomplish anything. He wrote a letter to the opposing party and had a call with opposing party's attorney resulting in absolutely nothing. In fact, when his office sent me an email summary of the call, for a moment, I thought that he was the opposing party's attorney not mine. Furthermore, I gave him critical talking points for the conversation with opposing attorney. To my shock and disappointment, he chose not to discuss them. I just received my final invoice and file. Not surprisingly, 90% of the file consists of my notes, observations, emails etc.....For an attorney who is supposedly an expert in undue influence and elderly abuse, I was extremely disappointed. Dan did not move the needle at all andwas subsequently fired. $10,000 and two months later, nothing accomplished.

How do I choose a lawyer?

Consider the following:

  • Comfort Level – Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?
  • Credentials – How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?
  • Cost – How are the lawyer's fees structured — hourly or flat fee? Can the lawyer estimate the cost of your case?
  • City – Is the lawyer's office conveniently located?

Not sure what questions to ask a lawyer?

Here are a few to get you started:

  • How long have you been in practice?
  • How many cases like mine have you handled?
  • How often do you settle cases out of court?
  • What are your fees and costs?
  • What are the next steps?

Want to check lawyer discipline?

It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:

  • Ensure the attorney is currently licensed to practice in your state
  • Gain an understanding of his or her historical disciplinary record, if any.
  • Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
