Overview
The path to permanent residency through the typical labor certification process, which requires a test of the labor market, can take several years. In addition, given the current economy, it can be difficult, if not impossible, to recruit for a position without identifying a qualified and willing U.S. worker. As a result, many foreign nationals are looking to alternate paths to permanent residency, through employment or investment in the U.S.
While all of immigration law can be complex and difficult to understand, immigration based on exceptional, outstanding, and extraordinary abilities, or investment in the U.S. can be particularly complicated. However, successful navigation through the immigration laws in this area can lead to the desired achievement of permanent residency.
