Clyde Pearce is a native Californian and the principal of Clyde Pearce Law, which serves the Bay Area, including Monterey County. His more than 35 years as an attorney comprise legal experience that is both wide and deep. He has been admitted to practice in California, Arizona, Utah, and Virginia. He practices in state and federal courts, including both the Ninth and Tenth Circuits as well as the Federal Court of Contract Appeals, and the Court of Appeals for the Federal Circuit.

Perhaps his most acclaimed work was his representation of a publicly traded company that had agreed with the Government of Mexico to build and operate a landfill in the State of San Luis Potosi (Metalclad v. United Mexican States). The dispute led to Mr. Pearce filing the first case under NAFTA against Mexico. Pitted against the lawyers of the Mexican Government and several other firms the government retained, Mr. Pearce and his team prevailed before the international NAFTA tribunal. In a unanimous 3-0 decision, the Tribunal awarded his client $16.7 million. The Metalclad case is a landmark in international law and NAFTA and has been written and spoken about prolifically-including articles and lectures by Mr. Pearce.

Prior to the Metalclad NAFTA case, Mr. Pearce served as General Counsel to the General Services Administration of the U.S. supervising a legal staff of approximately 300. There he was the first-and so far as is known the only-General Counsel to try a case on the agency's behalf, a contract dispute with AT&T and the "Baby Bells" relating to what, at the time, was the largest single non-Defense contract in U.S. history for more than $25 billion.

Mr. Pearce was a partner in the a.v. rated national law firm of Rivkin Radler Dunne and Bayh in both the Washington, D.C. and Century City offices.

Mr. Pearce earned his Juris Doctorate from the University of Utah College of Law where he was recognized for his advocacy skills as Chief Justice of the Moot Court Society. His bachelor's degree in Political Science and English was awarded by Brigham Young University where he played intercollegiate football and baseball.

He is the proud and active grandfather of seven grandchildren.

One of three panelists on National Public Radio in response to Bill Moyers' T.V. special on NAFTA (Summer 2001).

Mr. Pearce is also skilled in cases involving the Perishable Agricultural Commodities Act (PACA).

How do I choose a lawyer?

Consider the following:

Comfort Level
- Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?

Credentials
- How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?

Cost
- How are the lawyer's fees structured - hourly or flat fee? Can the lawyer estimate the cost of your case?

City
- Is the lawyer's office conveniently located?

Not sure what questions to ask a lawyer?

Here are a few to get you started:

  • How long have you been in practice?
  • How many cases like mine have you handled?
  • How often do you settle cases out of court?
  • What are your fees and costs?
  • What are the next steps?

Want to check lawyer discipline?

It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:

  • Ensure the attorney is currently licensed to practice in your state
  • Gain an understanding of his or her historical disciplinary record, if any.
  • Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
