We have over 20 years of experience at a preeminent, global law firm helping employers protect their bottom line and avoid litigation. We believe, "An ounce of prevention is worth a pound of cure." In our experience, the best prevention for employers is achieved through a combination of strong written policies and agreements, counseling, training, investigating and responding to internal employee complaints and administrative charges, and guidance with the discipline and discharge process.

Of course, sometimes litigation can't be avoided. For those times, your business deserves experienced and strong advocates. At Hutcheson Bowers, we have extensive experience litigating and arbitrating a broad range of employment matters, from claims of traditional discrimination, harassment and retaliation to matters arising out of layoffs, severance, and commission, bonus and stock option plans.

In addition to our traditional employment law experience, we have also successfully prosecuted numerous trade secret cases utilizing a variety of legal theories including breach of nonsolicitation, nondisclosure and noncompetition agreements; misappropriation and theft of trade secrets; inevitable disclosure; breach of fiduciary duty and tortious interference.

Because of this experience, clients retain us to investigate when they suspect that their trade secrets have been compromised and to develop a plan for recouping any compromised information. We also work with our clients to develop proper policies and procedures to minimize the risk that departing employees will take our clients' trade secrets and use them to compete unlawfully.

How do I choose a lawyer?

Consider the following:

Comfort Level
- Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?

Credentials
- How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?

Cost
- How are the lawyer's fees structured - hourly or flat fee? Can the lawyer estimate the cost of your case?

City
- Is the lawyer's office conveniently located?

Not sure what questions to ask a lawyer?

Here are a few to get you started:

  • How long have you been in practice?
  • How many cases like mine have you handled?
  • How often do you settle cases out of court?
  • What are your fees and costs?
  • What are the next steps?

Want to check lawyer discipline?

It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:

  • Ensure the attorney is currently licensed to practice in your state
  • Gain an understanding of his or her historical disciplinary record, if any.
  • Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
