Chapter 7 Bankruptcy
While most consumers opt for Chapter 7, this type of bankruptcy isn't the right solution for everyone. Chapter 7 may be the right option for you if all of the following statements apply:
- You have not received a bankruptcy discharge in an earlier case filed within the past eight years.
- You don't have many assets that you'd have to surrender to a trustee.
- You're current on home and car payments, or willing to surrender them to the trustee.
- You don't have much money left over each month after paying expenses.

Chapter 13 Bankruptcy
Although Chapter 13 requires you to repay a portion or all of your debt over the course of a three- to five-year repayment plan, it is usually the preferable way to file in any of these situations:

- You need time to pay off past-due support obligations.
- You owe tax debts that you want to pay off without interest or penalties.
- You have significant non-exempt assets you would have to give up in a Chapter 7.
- You received a discharge in a bankruptcy case filed within the past eight years.
- You earn enough money to pay monthly expenses with ease and want to do your best to repay creditors at least some of the amount you owe.
