she then talked me into a chapter 13 with the promise I would own my home in 5 years so I converted over it took many months for her to even start the process, so long in fact that the classes I took online expired which I had to do over and after all that and a payment to chapter 13 clerk of $850 bucks the house wouldn't take in the 13 so it was converted to a 7 she PROMISED me I would receive the $850 bucks back I have called literally hundreds of times i'm not kidding me and her secretary are on a first name basis the third secretary I might add and the secretary knows my phone number by heart now, she dont even have to ask!! how familiar is that for you!! i've come to the conclusion after several months of calls and no call backs that she just flat out ripped me off I finally ask her secretary what are the chances she's going to call me back and she kinda chuckled and said: well you know the answer to that as well as I do. im disgusted it would have been different if she would have told me a 1500 bankruptcy would turn into a $2,890 one but she didn't, yeah that's right I had to spend an additional $500 to get my house appraised by a guy she recommended personally I think the whole thing is a scam. I'll be contacting the bar association as well as another attorney and will file a complaint with the B.B.B against her the reason for this review is so that no one gets burnt like I did and if I can save one person from hiring this particular attorney then I feel ill have gotten the money back that was promised to me. It's christmas time and because of what she did I can't get my kids hardly anything for christmas and we have been struggling every since we paid her just to be more informative we did everything right she received all the paperwork she requested within 2 days and all of her payment within 3 weeks and then received additional payment as soon as she requested in a timely manner for the appraiser also something that took three months to get done after we paid her i'm telling you this attorney is as crooked as Eric conn BUYER BEWARE please if you are reading this seek out a different attorney!!!

I represented the above referenced reviewer in a Bankruptcy Case. I met with him and his wife initially and went over his information. I explained the difference between a chapter 7 and a chapter 13. My fee for a chapter 7 Bankruptcy is $1500., and $3500. for a chapter 13. With 2000.00 of the Chapter 13 being paid through the Chapter 13 plan. I explain the options to my clients and any possible issues that I foresee, but I do not choose which chapter to file. I spoke with the clients several times. There is a problem with the title to their mobile home and there was a possibility that the Trustee could set aside the lien and sell his home or he would be required to purchase it from the Trustee. I explained that there was a possibility that we could put the mobile home in a chapter 13 plan and pay the value of it through the plan and it could possibly be paid off in five years. I also explained that it was possible but not guaranteed. I explained that the mobile home would have to be appraised. I contacted an appraiser that I only know through the Bankruptcy Court and had him do an appraisal. The appraiser does his own scheduling. I do not know him personally. He is the only appraiser in this area that will appraise a mobile home without it being attached to the land. When we went to the Chapter 13 341 Meeting of Creditors, the Trustee advised that he thought their mortgage was valid and was not going to pursue trying to set it aside. I explained this to the clients and they decided to convert their case to a Chapter 7, which I did and they received a discharge on November 14, 2019. When a case is converted the Chapter 13 Trustee will send any money they have remaining on hand to the debtor. Because part of my fee was included in the Chapter 13 plan the Trustee sent me $789.65 as part of my fee. I wrote a check to the clients and put in his file, even though it was part of my fee. When I realized he had not picked up the check, I had my assistant call the client and tell him we had the check and he could pick it up. The Co-debtor came in and picked up the check on December 23. I am sorry that the client was not satisfied with my services; however, I know of nothing I could have done differently.

How do I choose a lawyer?

Consider the following:

Comfort Level
- Are you comfortable telling the lawyer personal information? Does the lawyer seem interested in solving your problem?

Credentials
- How long has the lawyer been in practice? Has the lawyer worked on other cases similar to yours?

Cost
- How are the lawyer's fees structured - hourly or flat fee? Can the lawyer estimate the cost of your case?

City
- Is the lawyer's office conveniently located?

Not sure what questions to ask a lawyer?

Here are a few to get you started:

  • How long have you been in practice?
  • How many cases like mine have you handled?
  • How often do you settle cases out of court?
  • What are your fees and costs?
  • What are the next steps?

Want to check lawyer discipline?

It is always a good idea to research your lawyer prior to hiring. Every state has a disciplinary organization that monitors attorneys, their licenses, and consumer complaints. By researching lawyer discipline you can:

  • Ensure the attorney is currently licensed to practice in your state
  • Gain an understanding of his or her historical disciplinary record, if any.
  • Determine the seriousness of complaints/issues which could range from late bar fees to more serious issues requiring disciplinary action.
