Overview

Brian C. Duffy is a partner of Nelson Mullins Riley & Scarborough LLP in Charleston. Mr. Duffy's practice focuses primarily on litigation; he also counsels corporate clients regarding other issues their businesses face. Mr. Duffy is a mediator certified by the United States District Court and by the South Carolina Board of Arbitrator and Mediator Certification. In addition, Mr. Duffy serves as an Adjunct Professor of Commercial Law at the Charleston School of Law.

A member of the South Carolina Bar and the District of Columbia Bar, Mr. Duffy is admitted to practice before the Supreme Court of the United States; the U.S. Courts of Appeals for the District of Columbia, Eleventh and Federal Circuits; the U.S. District Courts for the District of South Carolina and the District of Columbia; and the U.S. Court of Federal Claims.

Prior to joining Nelson Mullins in 2004, Mr. Duffy was associated with a leading U.S. law firm in Washington, D.C. During 2000-01, Mr. Duffy served as associate counsel of the Judicial Review Commission on Foreign Assets Control. From 1999 to 2000, he served as a law clerk to U.S. Circuit Judge Karen L. Henderson of the U.S. Court of Appeals for the District of Columbia Circuit, and from 1998-99, Mr. Duffy served as a law clerk to U.S. District Judge C. Lynwood Smith, Jr. of the Northern District of Alabama.
During the confirmation hearings of John G. Roberts, Jr. as Chief Justice of the United States, Mr. Duffy submitted written testimony at the invitation of the Chairman of the Senate Committee on the Judiciary. Mr. Duffy also has appeared before the U.S. Supreme Court in a victory on behalf of a national bank.

A member of the American Bar Association, Mr. Duffy is also a member of the Charleston County Bar Association and the South Carolina Defense Attorneys' Association. He is the author of Barring Foul Blows, 50 Vand. L. Rev. 1335 (1997) and the co-author of Admissibility of Expert Testimony: South Carolina's Standard in Relation to and in Light of Daubert, 25:1, The Defense Line, 6 (1997).

In 1998, Mr. Duffy earned a Juris Doctor from the Vanderbilt University School of Law where he was Notes Editor of Vanderbilt Law Review, a John W. Wade Scholar, a member of the Philip C. Jessup International Law Moot Court Competition, and an orator in the Student Scholarship Series. Mr. Duffy earned a Bachelor of Arts in Political Science, with highest distinction, from the University of North Carolina at Chapel Hill in 1995.
