Dallas Federal Criminal Litigation Lawyer

Overview

Dr. Nick Oberheiden is the firm's Managing Principal. His practice areas are limited to U.S. constitutional law, federal criminal defense, government investigations, federal litigation, healthcare law, and cases involving non- U.S. citizens or foreign legal systems.

In civil cases, Dr. Oberheiden represents individuals, entrepreneurs, and businesses in litigation matters across the United States. A great deal of these cases are healthcare related. For example, in Aegis Sciences Corporation v. Millennium Laboratories, Inc. Case 7:11-cv-00126-KKC-EBA, a multi-district healthcare litigation spanning federal courts in Tennessee, Texas, Georgia, and Florida, Dr. Oberheiden successfully argued for a de novo interpretation of a highly practical issue under Rule 45 Federal Rules of Civil Procedure re-defining the subpoena authority of attorneys under federal law.

In criminal cases, individual and corporate clients hire Dr. Oberheiden and his team from all across the United States seeking protection against expected or pending criminal charges and government investigations. To provide such protection fast and efficiently, Dr. Oberheiden has developed the "Emergency Defense Package," an emergency protocol designed to instantly address clients' needs and concerns when facing criminal prosecution. When it comes to defending his clients' future and livelihood, Dr. Oberheiden approaches each case with maximum dedication and determination and with the objective to get each and every client the absolute best outcome under the circumstances.

Recent criminal defense engagements include False Claims Act (dismissed), Medicare fraud (dismissed), Tricare fraud (dismissed), federal fraud (dismissed), immigration offenses (no charges), and federal drug cases (no charges). For more information, see here.

With respect to healthcare law, Dr. Oberheiden routinely leads clients in Qui Tam, False Claims Act, Medicare Fraud, Tricare Fraud, Stark Law, and anti-kickback proceedings before the Office of Inspector General (OIG), the Department of Health and Human Services (HHS), the Department of Defense (DOD), the Department of Justice (DOJ), the Department of Labor (DOL), the Drug Enforcement Administration (DEA), and the Federal Bureau of Investigation (FBI), among others.

Since 2011, Dr. Oberheiden has accepted several engagements by nationally operating companies to serve as outside Chief Counsel to advise on compliance and litigation in the areas of federal securities, Stark Law, Anti-Kickback, and corporate integrity.

Dr. Oberheiden received a Ph.D., magna cum laude, from the University of Heidelberg, Germany with a comparative thesis on U.S., German, and Brazilian constitutional law (2010), a Juris Doctor from UCLA School of Law (2007), as well as a Juris Doctor equivalent from the Supreme Court in his native of Hamburg, Germany (2004). He has taught U.S. constitutional law, problems in evidence, SEC & DOJ law enforcement procedures, U.S. civil procedure, and international law around the world, including the United States, France, Brazil, South Africa, Namibia, and Germany.

He is admitted to practice before the U.S. Supreme Court, the U.S. Court of Appeals (2nd & 5th Circuit), the U.S. District Court for the Northern, Southern, Western, and Eastern District of Texas, as well as the U.S. District Court for the Southern and Eastern District of New York. He is a member of the bar of the State of New York and the District of Columbia.

Dr. Oberheiden and his family live in Dallas, Texas, where they actively support the community and promote innovative ideas in the area of childhood education and child protection.
