Overview
Maxey M. Scherr is the Founder, CEO, and Lead Attorney of Scherr Law Firm, a trial law firm focused on catastrophic injury, trucking litigation, traumatic brain injury, wrongful death, and complex personal injury matters. Since 2009, Ms. Scherr has litigated countless jury trials, securing multi-million-dollar verdicts and settlements. In 2022, she founded Scherr Law Firm and, while she practices throughout the United States, she is licensed in Texas, New Mexico, and Illinois.
Board Certified in Truck Accident Law by the National Board of Trial Advocates and in Personal Injury Law by the Texas Board of Legal Specialization, Ms. Scherr has extensive experience in commercial truck crashes, traumatic brain injuries, wrongful death claims, product liability, and the identification of non-obvious third-party defendants. She has extensive experience trying complex trucking cases and is recognized for her knowledge of the legal, scientific, and evidentiary issues that arise in catastrophic injury litigation. Ms. Scherr earned her Bachelor of Science in Psychology, magna cum laude, from the University of Massachusetts Boston and her Juris Doctor from Texas Tech School of Law. She also completed postgraduate studies in Neuroscience at Harvard University.
Ms. Scherr currently serves as President-Elect of the Executive Board of the Academy of Truck Accident Attorneys (ATAA) and sits on its Board of Regents. She has previously served as Board Secretary, Board Parliamentarian, and Co-Chair of the Women's Caucus. Within the American Association for Justice (AAJ) Trucking Litigation Group, Ms. Scherr serves as an Executive Board officer and was recently elected to serve as Chair of the Underride Committee alongside Chrissy Hagen. She also co-chairs the organization's Trucking Journal publication and manages the Broker Database. For AAJ's Traumatic Brain Injury Litigation Group, Ms. Scherr was recently elected Treasurer. She previously acted as Parliamentarian, the Brain Injury Association of America liaison, and Women's Caucus Co-Chair. Ms. Scherr also serves on the Rules of Evidence Committee for the State Bar of Texas.
Widely recognized as an authority in trucking and brain injury litigation, Ms. Scherr frequently presents to fellow attorneys and publishes articles addressing significant issues in trucking litigation, traumatic brain injuries, and trial advocacy. She is an active advocate for heightened trucking safety standards and dedicates significant effort to supporting brain injury victims and mentoring the next generation of legal professionals.
Ms. Scherr's commitment to advocacy and service has been recognized through numerous professional honors. This year, she received the AAJ Trucking Litigation Group Award. In 2025, she and Scherr Law Firm received the Legal Champion Award at the Brain Injury Association of America's Luminary of the Year ceremony in Washington, D.C. In 2025, she received the Roxanne Barton Conlin Certificate of Recognition at the 2025 AAJ Annual Convention for exemplary service through fundraising, membership, advocacy, and education. At the same convention, she received AAJ's Trucking Litigation Group's Distinguished Service Award. In 2024, Ms. Scherr was recognized by TopVerdict.com after obtaining two Top Five Verdicts and two Top Five Settlements in Texas. She also received national recognition for a Top 10 Truck Accident Settlement, a Top 20 Truck Accident Verdict, and two Top 20 Occupational Injury Verdicts.
In her hometown of El Paso, Ms. Scherr serves as a Downtown Management District Board Member and is a Founding Member of the Women's Rights Commission. In 2023, she launched the Scherr Law Firm Scholarship and Internship Program for local students exploring careers in law. Each summer, the firm also offers a paid clerkship to exceptional law school students.
As Co-Founder of Sisterhood of the 8, Inc., a woman-led organization of trial attorneys dedicated to breaking barriers and empowering women in the legal profession, Ms. Scherr has been instrumental in numerous initiatives, including the organization's signature "trial jackets" collaboration designed to inspire confidence in the courtroom, its annual rally, scholarship initiatives, and a nationwide listserv connecting members and fostering professional success both inside and outside the courtroom.

Scherr Law Firm secures $10.65 million verdict in firm's first trial. The plaintiff, a 28-year old Swift Transportation female truck driver, suffered a permanent traumatic brain injury, among other medical conditions, when a semi-trailer door came crashing down on the back of her head on September 27, 2017.

Sought damages for a minor child who suffered a traumatic brain injury. Previous attorney was unable to get case resolved at low five-figure amount before case was transferred to Maxey Scherr. After Ms. Scherr began working this case, the defense hired a multitude of experts to defeat the claims. Ultimately, this was unsuccessful for the defense and case concluded in a confidential large settlement.

Litigated against a major trucking corporation in which the driver caused a multicar collision. Concluded in a confidential large settlement and admission of gross negligence by trucking corporate representative once egregious falsification of log issues exposed and uncovered by Ms. Scherr.
