Overview
Phillip serves as the President of the firm and focuses his practice on energy, utility, and telecommunications matters. He represents a broad spectrum of energy clients, including industrial and commercial energy users, municipal and cooperative utilities, and renewable energy project developers. His representation of commercial and industrial energy customers includes negotiation of power and natural gas purchase and sale agreements, utility contract negotiations, energy project development, utility rate cases, utility litigation and general business litigation. His representation of municipal and cooperative utilities includes project development, contract negotiation, power and gas purchase agreements, regulatory matters and commercial litigation. He has appeared in administrative proceedings before public service commissions in Utah and Wyoming and before the Federal Energy Regulatory Commission. Phillip's energy clients include the Utah Association of Energy Users, which includes Airgas, American Pacific Corporation, Chevron U.S.A., ConocoPhillips, Hexcel Corporation, Intermountain Health Care, Northrup Grumman, Simplot Phosphates, Texas Instruments, Utah State University, and Wal-Mart; Magnum Energy, LLC; US Magnesium LLC; the University of Utah; Payson City; Salem City; Spanish Fork City; St. George City, Deseret Power; and various renewable energy developers. Phillip also represents the Community Renewable Energy Agency in its efforts to develop a Program with Rocky Mountain Power to enable residents in numerous Utah Communities to receive 100% of their electricity needs from renewable resources.
Phillip represents telecommunications clients in a broad range of matters, including general litigation matters and with respect to applications filed with the Public Service Commission of Utah seeking a certificate of public convenience and necessity, designation as an eligible telecommunications carrier, and competitive entry. Phillip's recent telecommunications clients include Frontier Communications; SpaceX; Commnet Wireless, LLC; Telrite Corporation, among others.
Phillip also handles a wide variety of commercial litigation matters, including disputes related to contracts, trade secrets, patents, real estate development, corporate malfeasance, business torts, and real property disputes, among others.
